H.F. 2235 Section 1. FEDERAL HEALTH CARE REFORM MEASURES —— 1 PROHIBITION OF FUNDING FOR ABORTIONS. 2 1. The use of funds appropriated under or appropriated 3 to any trust fund pursuant to the federal Affordable Health 4 Care for Americans Act, the federal Patient Protection and 5 Affordable Care Act, or any successor legislation, shall be 6 restricted in this state as follows: 7 a. Such funds shall not be expended for any abortion in this 8 state. 9 b. Such funds shall not be expended for health insurance 10 coverage, health benefits, or health services that include 11 coverage for abortion, provided through a contract or other 12 arrangement with a carrier as defined in section 513B.2. 13 2. The restrictions of this section shall not apply to the 14 use of such funds for an abortion if the woman suffers from 15 a physical disorder, physical injury, or physical illness, 16 including a life-endangering physical condition caused by or 17 arising from the pregnancy itself, that would, as certified 18 by a physician, place the woman in danger of death unless an 19 abortion is performed. 20 Sec. 2. EFFECTIVE UPON ENACTMENT. This Act, being deemed of 21 immediate importance, takes effect upon enactment. 22 EXPLANATION 23 This bill restricts the use of funds appropriated under 24 or appropriated to any trust fund pursuant to federal health 25 care reform legislation for use in this state, by prohibiting 26 expenditure of such funds for an abortion in the state and for 27 health insurance coverage, health benefits, or health services 28 that include coverage for abortion, provided by a carrier. The 29 restrictions do not apply, however, if the woman suffers from 30 a physical disorder, physical injury, or physical illness, 31 including a life-endangering physical condition caused by or 32 arising from the pregnancy itself, that would, as certified 33 by a physician, place the woman in danger of death unless an 34 abortion is performed. 35 -1- LSB 5851YH (5) 83 pf/nh 1/ 2
