H.F. 2227 Section 1. Section 142D.4, Code 2009, is amended by adding 1 the following new subsection: 2 NEW SUBSECTION . 12. Duly incorporated and acting posts or 3 chapters of veterans organizations operating under a United 4 States congressional charter, if approved by the governing body 5 of the post or chapter, except when being used for a function 6 to which the general public is invited. This exemption shall 7 not apply to any entity that is established for the purpose of 8 avoiding compliance with this chapter. 9 EXPLANATION 10 This bill provides that duly incorporated and acting posts 11 or chapters of veterans organizations operating under a United 12 States congressional charter, if approved by the governing 13 body of the post or chapter, are exempt from the smoking 14 prohibitions of the smokefree air Act, except when being 15 used for a function to which the general public is invited. 16 However, the exemption does not apply to any entity that is 17 established for the purpose of avoiding compliance with the 18 Act. 19 -1- LSB 5962YH (4) 83 pf/nh 1/ 1
