Section
1.
Section
26.2,
subsection
2,
Code
2009,
is
amended
1
to
read
as
follows:

“Governmental
entity”
means
the
state,
political
3
subdivisions
of
the
state,
public
school
corporations,
and
all
4
officers,
boards,
or
commissions
empowered
by
law
to
enter
5
into
contracts
for
the
construction
of
public
improvements,
6
excluding
the
state
board
of
regents
;
and
the
state
department
7
of
transportation
;
and
the
governing
body
of
any
drainage
or
8
levee
district
as
provided
in
chapter
468,
including
a
board
as
9
defined
in
section
468.3,
when
acting
under
that
chapter
.

Sec.
2.
EFFECTIVE
UPON
ENACTMENT.
This
Act,
being
deemed
of
11
immediate
importance,
takes
effect
upon
enactment.

EXPLANATION
13
This
bill
amends
Code
chapter
26,
the
Iowa
Construction
14
Bidding
Procedures
Act,
which
establishes
requirements
15
applicable
to
state
and
local
governmental
entities
when
16
bidding
and
letting
contracts
for
public
improvements.
The
17
bill
excludes
the
governing
body
of
a
drainage
or
levee
18
district
from
these
requirements.
The
governing
body
for
a
19
drainage
or
levee
district
includes
a
board
of
supervisors,
the
20
joint
boards
of
supervisors
in
case
of
an
intercounty
levee
21
or
drainage
district,
or
the
board
of
trustees
in
case
of
a
22
district
under
trustee
management.
