Section
237A.6,
Code
2009,
is
amended
to
read
as

follows:

Consultative
services
——
requirement

professional

and
urging
registration
or
licensure

1.
The
department
shall,
and
the
director
of
public
health
6
may
provide
consultative
services
to
a
person
applying
for
7
a
license
or
registration,
or
licensed
or
registered
by
the
8
administrator
under
this
chapter.

2.
The
department
of
human
services
and
the
department
10
of
public
health,
or
an
employee
or
contractor
of
either
11
department,
shall
not
formally
or
informally
require
or
urge
a
12
child
care
provider
or
the
staff
of
such
a
provider
to
become
a
13
member
of
a
professional
organization
representing
child
care
14
providers.

3.
If
a
person
is
providing
child
care
as
a
child
care
home
16
provider,
the
department
of
human
services
and
the
department
17
of
public
health,
or
an
employee
or
contractor
of
either
18
department,
shall
not
urge
the
person
or
the
person’s
staff
to
19
become
a
registered
or
licensed
child
care
provider.

EXPLANATION
21
This
bill
prohibits
the
departments
of
human
services
and
22
public
health
from
formally
or
informally
requiring
or
urging
23
child
care
providers
to
become
members
of
a
professional
24
organization
representing
such
providers.
The
bill
also
25
prohibits
the
two
departments
from
urging
unregistered
child
26
care
home
providers
to
become
registered
or
licensed.
Code
27
section
237A.6,
relating
to
the
consultative
services
provided
28
by
the
two
departments
to
child
care
providers,
is
amended
to
29
include
the
prohibitions.
