H.F. 2199 Section 1. Section 147.108, subsection 2, Code 2009, is 1 amended to read as follows: 2 2. After contact lenses have been adequately adapted and 3 the patient released from initial follow-up care by a person 4 licensed under chapter 148 or 154, the patient may request 5 a copy, at no cost, of the contact lens prescription from 6 that licensed person. A person licensed under chapter 148 or 7 154 shall not withhold a contact lens prescription after the 8 requirements of this section have been met. The prescription, 9 at the option of the prescriber, may be given orally only to a 10 person who is actively practicing and licensed under chapter 11 148, 154, or 155A. The contact lens prescription shall contain 12 an expiration date, at the discretion of the prescriber, but 13 not to exceed eighteen months. The contact lens prescription 14 shall contain the necessary requirements of the ophthalmic 15 lens, and the prescription validation requirements as defined 16 by rules adopted pursuant to this section. The prescription 17 may contain adapting and material guidelines and may also 18 contain specific instructions for use by the patient. For 19 the purpose of this section, “ophthalmic lens” means one which 20 has been fabricated to fill the requirements of a particular 21 contact lens prescription , including pharmaceutical-delivering 22 contact lenses as defined in section 154.1, subsection 4 . 23 Sec. 2. Section 154.1, subsection 4, Code 2009, is amended 24 to read as follows: 25 4. a. Therapeutically certified optometrists may employ 26 all diagnostic and therapeutic pharmaceutical agents for the 27 purpose of diagnosis and treatment of conditions of the human 28 eye and adnexa pursuant to this subsection, excluding the 29 use of injections other than to counteract an anaphylactic 30 reaction, and notwithstanding section 147.107, may without 31 charge supply any of the above pharmaceuticals to commence a 32 course of therapy. 33 b. Therapeutically certified optometrists may 34 employ and, notwithstanding section 147.107, supply 35 -1- LSB 5179HV (2) 83 jr/nh 1/ 3
H.F. 2199 pharmaceutical-delivering contact lenses for the purpose 1 of treatment of conditions of the human eye and adnexa. 2 For purposes of this paragraph, “pharmaceutical-delivering 3 contact lenses” means contact lenses that contain one or more 4 therapeutic pharmaceutical agents authorized for employment 5 by this section for the purpose of treatment of conditions of 6 the human eye and adnexa and that deliver such agents into the 7 wearer’s eye. 8 c. Therapeutically certified optometrists may prescribe 9 oral steroids for a period not to exceed fourteen days 10 without consultation with a physician. Therapeutically 11 certified optometrists shall not prescribe oral Imuran or oral 12 Methotrexate. 13 d. Therapeutically certified optometrists may be authorized, 14 where reasonable and appropriate, by rule of the board, to 15 employ new diagnostic and therapeutic pharmaceutical agents 16 approved by the United States food and drug administration on 17 or after July 1, 2002, for the diagnosis and treatment of the 18 human eye and adnexa. 19 e. The board shall not be required to adopt rules relating 20 to topical pharmaceutical agents, oral antimicrobial agents, 21 oral antihistamines, oral antiglaucoma agents, and oral 22 analgesic agents. Superficial foreign bodies may be removed 23 from the human eye and adnexa. 24 f. The therapeutic efforts of a therapeutically certified 25 optometrist are intended for the purpose of examination, 26 diagnosis, and treatment of visual defects, abnormal 27 conditions, and diseases of the human eye and adnexa, for 28 proper optometric practice or referral for consultation or 29 treatment to persons licensed under chapter 148. 30 g. A therapeutically certified optometrist is an optometrist 31 who is licensed to practice optometry in this state and who 32 is certified by the board to use the agents and procedures 33 authorized pursuant to this subsection. 34 -2- LSB 5179HV (2) 83 jr/nh 2/ 3
H.F. 2199 EXPLANATION 1 Code section 154.1 authorizes therapeutically certified 2 optometrists to employ all diagnostic and therapeutic 3 pharmaceutical agents for the purpose of diagnosis and 4 treatment of conditions of the human eye and adnexa. This 5 bill allows therapeutically certified optometrists to also 6 supply therapeutic contact lenses for the purpose of treatment 7 of conditions of the human eye and adnexa. The bill defines 8 these lenses as contact lenses that contain one or more of the 9 authorized therapeutic pharmaceutical agents and that deliver 10 the agents into the wearer’s eye. 11 The bill makes a conforming amendment to Code section 12 147.108, relating to contact lens prescribing and dispensing. 13 -3- LSB 5179HV (2) 83 jr/nh 3/ 3
