H.F. 2182 Section 1. NEW SECTION . 103.1A Term “commercial” applied. 1 1. Whenever the term “commercial” is used in this chapter, 2 it shall refer to a use, installation, structure, or premises 3 associated with a place of business where goods, wares, 4 services, or merchandise is stored or offered for sale on a 5 wholesale or retail basis. 6 2. The term “commercial” refers to a residence only if the 7 residence is also used as place of business as provided in 8 subsection 1. 9 3. The term “commercial” does not refer to a use, 10 installation, structure, or premises associated with any of the 11 following: 12 a. A farm. 13 b. An industrial installation. 14 Sec. 2. Section 103.22, subsection 7, Code Supplement 2009, 15 is amended to read as follows: 16 7. Prohibit an owner of property from performing work on the 17 owner’s principal residence, if such residence is an existing 18 dwelling rather than new construction and is not an apartment 19 that is attached to any other apartment or building, as those 20 terms are defined in section 499B.2, and is not larger than a 21 single-family dwelling, or farm property, excluding commercial 22 or industrial installations or installations in public use 23 buildings or facilities, or require such owner to be licensed 24 under this chapter. In order to qualify for inapplicability 25 pursuant to this subsection, a residence shall qualify for the 26 homestead tax exemption. 27 Sec. 3. Section 103.22, Code Supplement 2009, is amended by 28 adding the following new subsection: 29 NEW SUBSECTION . 15. Apply to a person performing any 30 installation on a farm, if the person is associated with the 31 farm as a holder of a legal or equitable interest, a relative 32 or employee of the holder, or an operator or manager of the 33 farm. The provisions of this chapter do not require such 34 person to be licensed. In addition, a permit is not required 35 -1- LSB 5885HH (4) 83 da/nh 1/ 2
H.F. 2182 for an installation on a farm, and an installation on a farm is 1 not required to be inspected. In order for a farm building to 2 qualify under this subsection, it cannot regularly be open to 3 the public as a place of business for the retail sale of goods, 4 wares, services, or merchandise. 5 Sec. 4. EFFECTIVE UPON ENACTMENT. This Act, being deemed of 6 immediate importance, takes effect upon enactment. 7 EXPLANATION 8 This bill amends Code chapter 103 which provides for the 9 regulation of electricians and electrical contractors. The 10 bill provides that when the chapter uses the term “commercial” 11 it refers to a place of business where goods, wares, services, 12 or merchandise is stored or offered for sale on a wholesale 13 or retail basis. It refers to a residence only when used as 14 a business, and it does not refer to a farm, or an industrial 15 installation. 16 Generally, the Code chapter requires that a person must be 17 licensed as an electrical contractor to provide for electrical 18 installations. The bill rewrites a provision which exempts 19 installation on farms. The bill provides that the Code 20 chapter’s requirements do not apply to a person performing any 21 installation by a farmer, employee or relative of the farmer, 22 or farm operator or manager.
