H.F. 2173 Section 1. Section 8A.311, subsection 12, Code 2009, is 1 amended to read as follows: 2 12. a. The state and its political subdivisions shall give 3 preference to purchasing Iowa products and purchasing from 4 Iowa-based businesses if the bids submitted are comparable in 5 price to those submitted by other bidders and meet the required 6 specifications. 7 b. For disaster recovery products in an area that the 8 governor has proclaimed a disaster emergency or the president 9 of the United States has declared a major disaster, preference 10 may be given to Iowa products and Iowa-based businesses 11 even if bids submitted for out-of-state products and by 12 out-of-state businesses are lower in price and meet the 13 required specifications provided the following criteria are met 14 for procurement through competitive bidding or requests for 15 proposals: 16 (1) For bids and proposals of twenty-five thousand 17 dollars or less, the Iowa bid or proposal does not exceed the 18 acceptable low bid or acceptable low proposal by more than ten 19 percent. 20 (2) For bids and proposals of more than twenty-five thousand 21 dollars and less than two hundred thousand dollars, the Iowa 22 bid or proposal does not exceed the acceptable low bid or 23 acceptable low proposal by more than five percent. 24 (3) For bids and proposals of two hundred thousand 25 dollars or more, the Iowa bid or proposal does not exceed the 26 acceptable low bid or acceptable low proposal by more than one 27 percent. 28 EXPLANATION 29 This bill relates to purchasing preferences for disaster 30 recovery related products. 31 Currently, the state and its political subdivisions must 32 give preference to purchasing Iowa products and purchasing from 33 Iowa-based businesses if the bids submitted are comparable in 34 price to those submitted by other bidders and meet the required 35 -1- LSB 5934YH (5) 83 tm/nh 1/ 2

The bill allows the state and its political 1 subdivisions to give preference to Iowa products and Iowa-based 2 businesses even if bids submitted for out-of-state products 3 and by out-of-state businesses are lower in price and meet the 4 required specifications when the products are necessary in a 5 disaster recovery in an area that the governor has proclaimed a 6 disaster emergency or the president of the United States has 7 declared a major disaster.
