Preliminary
screening
test.

When
a
peace
officer
has
reasonable
grounds
to
believe
that
2
a
violation
of
section
123.46
or
123.47
has
occurred,
the
peace
3
officer
may
request
that
the
person
provide
a
sample
of
the
4
person’s
breath
for
a
preliminary
screening
test
using
a
device
5
approved
by
the
commissioner
of
public
safety
for
that
purpose.

The
results
of
this
preliminary
screening
test
may
be
used
as
7
evidence
in
a
prosecution
of
a
violation
of
section
123.46
or
8
123.47.

EXPLANATION
10
This
bill
provides
that
when
a
peace
officer
has
reasonable
11
grounds
to
believe
that
a
violation
of
Code
section
123.46
12
(consumption
of
alcohol
or
intoxication
in
public)
or
Code
13
section
123.47
(possession
of
alcohol
by
a
minor)
has
occurred,
14
the
peace
officer
may
request
that
the
person
provide
a
sample
15
of
the
person’s
breath
for
a
preliminary
screening
test
using
a
16
device
approved
by
the
commissioner
of
public
safety
for
that
17
purpose.
The
results
of
this
preliminary
screening
test
may
18
be
used
as
evidence
in
a
prosecution
of
a
violation
of
Code
19
section
123.46
or
123.47.
