H.F. 2154 Section 1. Section 422.7, Code Supplement 2009, is amended 1 by adding the following new subsection: 2 NEW SUBSECTION . 18. Subtract, to the extent not otherwise 3 deducted in computing adjusted gross income, an amount equal to 4 twenty percent of the cost associated with conducting wellness 5 programs and providing memberships at fitness facilities for 6 employees of the taxpayer. 7 Sec. 2. Section 422.35, Code Supplement 2009, is amended by 8 adding the following new subsection: 9 NEW SUBSECTION . 9. Subtract, to the extent not otherwise 10 deducted in computing taxable income, an amount equal to 11 twenty percent of the cost associated with conducting wellness 12 programs and providing memberships at fitness facilities for 13 employees of the taxpayer. 14 Sec. 3. RETROACTIVE APPLICABILITY. This Act applies 15 retroactively to January 1, 2010, for tax years beginning on 16 or after that date. 17 EXPLANATION 18 This bill provides deductions from the computation of net 19 income to taxpayers subject to the individual or corporate 20 income taxes for 20 percent of the cost associated with 21 conducting wellness programs and providing memberships at 22 fitness facilities for employees. 23 The bill applies retroactively to January 1, 2010, for tax 24 years beginning on or after that date. 25 -1- LSB 5381YH (5) 83 tw/mg:sc 1/ 1
