H.F. 2128 Section 1. NEW SECTION . 321.276 Intentional distracted 1 driving. 2 1. A person operating a motor vehicle shall not 3 intentionally engage in an activity that distracts the person 4 from the safe operation of the motor vehicle. 5 2. This section does not apply to a member of a public 6 safety agency, as defined in section 34.1, engaged in the 7 performance of the member’s official duties. 8 3. A person convicted of a violation of this section commits 9 a simple misdemeanor punishable as a scheduled violation under 10 section 805.8A, subsection 6, paragraph “e” . 11 Sec. 2. Section 805.8A, subsection 6, Code Supplement 2009, 12 is amended by adding the following new paragraph: 13 NEW PARAGRAPH . e. For a violation under section 321.276, 14 the scheduled fine is one hundred dollars. 15 EXPLANATION 16 This bill prohibits a person from operating a motor vehicle 17 while intentionally engaging in an activity that distracts the 18 person from the safe operation of the motor vehicle. Members 19 of public safety agencies are exempt from the provisions in the 20 bill when performing their official duties. 21 A violation of the bill is a simple misdemeanor punishable by 22 a scheduled fine of $100. 23 -1- LSB 5447YH (7) 83 dea/nh 1/ 1
