1.
LEVEL
OF
CARE
EVALUATION.
The
department
of

human
services
shall
amend
the
medical
assistance
program

home
and
community-based
services
waiver
for
persons
with

intellectual
disabilities
so
that
required
evaluations

performed
subsequent
to
the
initial
diagnosis
of
mental
5
retardation
are
for
the
purpose
of
determining
the
appropriate
6
level
of
care
rather
than
confirming
the
original
diagnosis.

EXPLANATION

This
bill
requires
the
department
of
human
services
to
9
amend
the
medical
assistance
program
home
and
community-based
10
services
waiver
for
persons
with
intellectual
disabilities
11
so
that
evaluations
made
subsequent
to
the
initial
diagnosis
12
of
mental
retardation
are
for
the
purpose
of
determining
the
13
appropriate
level
of
care
rather
than
confirming
the
original

diagnosis.
