H.F. 2071 Section 1. Short title. This Act shall be known as the 1 “Iowa Opportunities Workforce Act” . 2 Sec. 2. Section 260C.14, Code Supplement 2009, is amended by 3 adding the following new subsection: 4 NEW SUBSECTION . 23. Adopt a policy, to take effect 5 not later than January 1, 2011, relating to an additional 6 classification of students for purposes of determining tuition 7 and fees that provides equal opportunity for granting resident 8 status to individuals who meet all of the following conditions: 9 a. Attended an accredited school in this state for at least 10 five years as of the date the individual graduated from an 11 accredited high school or received a high school equivalency 12 diploma in this state. 13 b. Is accepted for enrollment in a community college in this 14 state. 15 c. Was not required to pay tuition to attend a public high 16 school in this state. 17 d. Signs an affidavit, if the individual does not have a 18 social security number, stating that the individual will pursue 19 citizenship in the United States at the earliest possible time 20 the individual is able to do so. 21 Sec. 3. Section 262.9, Code Supplement 2009, is amended by 22 adding the following new subsection: 23 NEW SUBSECTION . 36. Adopt a policy, to take effect 24 not later than January 1, 2011, relating to an additional 25 classification of students for purposes of determining tuition 26 and fees that provides equal opportunity for granting resident 27 status to individuals who meet all of the following conditions: 28 a. Attended an accredited school in this state for at least 29 five years as of the date the individual graduated from an 30 accredited high school or received a high school equivalency 31 diploma in this state. 32 b. Signs an affidavit, if the individual does not have a 2 social security number, stating that the individual will pursue 3 citizenship in the United States at the earliest possible time 4 the individual is able to do so. 5 EXPLANATION 6 This bill directs the board of directors of a community 7 college and the state board of regents to adopt policies, 8 to take effect not later than January 1, 2011, relating to 9 an additional classification of students for purposes of 10 determining tuition and fees that provide equal opportunity 11 for granting resident status to certain individuals. The bill 12 includes a short title so that it will be known and may be cited 13 to as the “Iowa Opportunities Workforce Act”. 14 To meet the requirements of the policy, an individual 15 must have attended an accredited school in this state for 16 at least five years or received a high school equivalency 17 diploma in this state, be accepted for enrollment in a public 18 postsecondary institution in this state, must not have been 19 required to pay tuition to attend a public high school in this 20 state, and must sign an affidavit, if the individual does not 21 have a social security number, stating that the individual 22 will pursue U.S. citizenship at the earliest possible time the 23 individual is able to do so. 24 -2- LSB 5424YH (3) 83 kh/rj 2/ 2
