amended

as

the
board
and
operated
pursuant
to
this
chapter
and
games

using
mechanical
or
electronic
devices,
provided
that
the

authority
shall
not
authorize
a
monitor
vending
machine
or

a
player-activated
gaming
machine
that
utilizes
an
internal
14
randomizer
to
determine
winning
and
nonwinning
plays
and
that
15
upon
random
internal
selection
of
a
winning
play
dispenses
16
coins,
currency,
or
a
ticket,
credit,
or
token
to
the
player
17
that
is
redeemable
for
cash
or
a
prize,
and
excluding
gambling
18
or
gaming
conducted
pursuant
to
chapter
99B,
99D,
or
99F.

2009,
is
amended
by
striking

the
section
and
inserting
in
lieu
thereof
the
following:

retailer
may
sell
lottery
products
or
tickets
by
means
of

a
monitor
vending
machine
pursuant
to
the
requirements
of
the

authority,
but
only
if
all
of
the
following
conditions
are
met:

A
monitor
vending
machine
shall
only
be
permitted
26
or
offered
for
use
by
a
retailer
in
any
single
location
or
27
premises
for
which
a
class
“A”,
class
“B”,
class
“C”,
special
28
class
“C”,
or
class
“B”
beer
permit
has
been
issued
pursuant
29
to
chapter
123.

title
or
name

a
game
operated
on
a
monitor

vending
machine
shall
not
be
the
same
as
a
game
title
or
name

that

bee
used
or
is
authorized
for

EXPLANATION
1
This
bill
eliminates
a
provision
prohibiting
the
Iowa
2
lottery
authority
from
allowing
retailers
to
use
monitor
3
vending
machines
to
dispense
lottery
products
and
games.
The
4
bill
also
eliminates
the
additional
65
percent
excise
tax
on
5
monitor
vending
machine
revenues.
6
The
bill
permits
a
retailer
who
is
licensed
to
sell
alcohol
7
for
on-premises
consumption
to
sell
lottery
products
or
tickets
8
by
means
of
a
monitor
vending
machine.
The
bill
also
provides
9
that
the
game
title
or
name
of
a
game
operated
on
a
monitor
10
vending
machine
shall
not
be
the
same
as
a
game
title
or
name
11
utilized
as
a
gambling
game
under
Code
chapter
99F.
The
bill
12
grants
the
racing
and
gaming
commission
authority
to
ensure
13
that
game
titles
for
gambling
games
under
Code
chapter
99F
do
14
not
match
game
titles
or
names
for
games
dispensed
utilizing
a
15
monitor
vending
machine.
