is
amended
to
read
as
follows:

b.
Motorcycles.
3
(1)
A
person
shall
not
operate
or
ride
a
motorcycle
on
4
the
highways
with
another
person
on
the
motorcycle
unless
the
5
motorcycle
is
designed
to
carry
more
than
one
person.
The
6
additional
passenger
may
ride
upon
the
permanent
and
regular
7
seat
if
designed
for
two
persons,
or
upon
another
seat
firmly
8
attached
to
the
motorcycle
at
the
rear
of
the
operator.
The
9
motorcycle
shall
be
equipped
with
footrests
for
the
passenger
10
unless
the
passenger
is
riding
in
a
sidecar
or
enclosed
cab.
11
The
motorcycle
operator
shall
not
carry
any
person
nor
shall
12
any
other
person
ride
in
a
position
that
will
interfere
with
13
the
operation
or
control
of
the
motorcycle
or
the
view
of
the
14
operator.

(2)
A
person
shall
not
operate
a
motorcycle
on
the
highways
16
with
another
person
on
the
motorcycle
who
is
under
twelve
years
17
of
age.

EXPLANATION
19
This
bill
amends
current
law
concerning
the
operation
20
of
motorcycles
to
prohibit
transporting
a
passenger
who
is
21
under
12
years
of
age.
The
provision
does
not
apply
when
a
22
motorcycle
is
operated
in
a
parade
authorized
by
permit
from
23
local
authorities.
24
Under
existing
law,
a
person
who
violates
provisions
25
relating
to
the
transportation
of
passengers
on
a
motorcycle
26
commits
a
simple
misdemeanor,
punishable
by
a
scheduled
fine
27
of
$25.
That
penalty
is
applicable
for
a
violation
under
the
28
bill.
