H.F. 2014 Section 1. Section 105.9, subsection 3, Code Supplement 1 2009, is amended to read as follows: 2 3. a. All fees collected under this chapter shall be 3 retained by the board. The moneys retained by the board shall 4 be used for any of the board’s duties under this chapter, 5 including but not limited to the addition of full-time 6 equivalent positions for program services and investigations. 7 Revenues retained by the board pursuant to this section shall 8 be considered repayment receipts as defined in section 8.2. 9 Notwithstanding section 8.33, moneys retained by the board 10 pursuant to this section are not subject to reversion to the 11 general fund of the state. 12 b. If a licensing requirement under this chapter is repealed 13 prior to the expiration of a person’s license, the board shall 14 refund a portion of the license or renewal fee paid by the 15 licensee, prorated to the effective date of the repeal. 16 EXPLANATION 17 This bill requires the plumbing and mechanical systems board 18 to refund a prorated portion of a license or renewal fee if the 19 general assembly repeals a particular licensing requirement for 20 a plumber or mechanical professional under Code chapter 105. 21 -1- LSB 5114YH (5) 83 jr/nh 1/ 1
