H.F. 2008 Section 1. Section 481A.78, Code 2009, is amended to read 1 as follows: 2 481A.78 Stocking private water. 3 1. No private water may Private waters shall not be 4 stocked by the commission unless the owner agrees that such 5 waters shall be open to the public for fishing, except that 6 the commission may, after investigation to determine their 7 suitability as to size, depth, living conditions for fish, and 8 management, provide a breeding stock of fish for privately 9 owned farm ponds on request of the owner. 10 2. The commission shall, by rule, set fees to stock private 11 waters with fish, with a minimum fee of five hundred dollars, 12 regardless of the size of the private waters being stocked. 13 EXPLANATION 14 This bill requires the natural resource commission to set 15 fees to stock private waters with fish by rule, with a minimum 16 fee of $500 regardless of the size of the private waters being 17 stocked. Currently, the fish stocking fee, provided in rules, 18 is $25 per acre or fraction of an acre of the private waters 19 being stocked. 20 -1- LSB 5277HH (2) 83 av/nh 1/ 1
