  1 An Act relating to the adoption, application, and enforcement of
  2    energy conservation requirements as a part of the state
  3    building code.

  1  1    Section 1.  Section 103A.8A, Code 2007, is amended to read
  1  2 as follows:
  1  3    103A.8A  ENERGY CONSERVATION REQUIREMENTS.
  1  4    1.  The state building code commissioner shall adopt as a
  1  5 part of the state building code a requirement that new
  1  6 single=family or two=family residential all construction shall
  1  7 comply with energy conservation requirements.  The
  1  8 requirements adopted by the commissioner shall be based upon a
  1  9 nationally recognized standard or code for energy
  1 10 conservation.  The requirements shall only apply to
  1 11 single=family or two=family residential construction commenced
  1 12 after the adoption of the requirements.  This chapter shall
  1 13 not be construed to prohibit a governmental subdivision from
  1 14 adopting or enacting a minimum energy standard which is
  1 15 substantially in accordance and consistent with energy codes
  1 16 and standards developed by a nationally recognized
  1 17 organization in effect on or after July 1, 2002.  A
  1 18 governmental subdivision that adopts or enacts a minimum
  1 19 energy standard which is substantially in accordance and
  1 20 consistent with energy codes and standards developed by a
  1 21 nationally recognized organization shall adopt or enact any
  1 22 update or revision to the energy codes and standards.
  1 23    2.  The state building code commissioner may provide
  1 24 training to builders, contractors, and other interested
  1 25 persons on the adopted energy conservation requirements.
  1 26    Sec. 2.  Section 103A.10, subsection 4, Code 2007, is
  1 27 amended to read as follows:
  1 28    4.  Notwithstanding the provisions of section 103A.22,
  1 29 subsection 1:
  1 30    a.  Provisions, provisions of the state building code
  1 31 establishing thermal and lighting efficiency energy
  1 32 conservation standards shall be applicable to all new
  1 33 construction owned by the state, an agency of the state, or a
  1 34 political subdivision of the state, to all new construction
  1 35 located in a governmental subdivision which has adopted either
  2  1 the state building code or a local building code or
  2  2 compilation of requirements for building construction, and to
  2  3 all other new construction in the state which will contain
  2  4 more than one hundred thousand cubic feet of enclosed space
  2  5 that is heated or cooled.
  2  6    b.  Provisions of the state building code establishing
  2  7 lighting efficiency standards shall be applicable to all new
  2  8 construction owned by the state, an agency of the state or a
  2  9 political subdivision of the state and to all new
  2 10 construction, in the state, of buildings which are open to the
  2 11 general public during normal business hours.
  2 12    Sec. 3.  Section 103A.19, unnumbered paragraph 3, Code
  2 13 2007, is amended to read as follows:
  2 14    The specifications for all buildings to be constructed
  2 15 after July 1, 1977 2008, and which exceed a total volume of
  2 16 one hundred thousand cubic feet of enclosed space that is
  2 17 heated or cooled shall be reviewed by a registered architect
  2 18 or registered engineer for compliance with applicable energy
  2 19 efficiency standards.  A statement that a review has been
  2 20 accomplished and that the design is in compliance with the
  2 21 energy efficiency standards shall be signed and sealed by the
  2 22 responsible registered architect or registered engineer.  This
  2 23 statement shall be filed with the commissioner prior to
  2 24 construction.  If the specifications relating to energy
  2 25 efficiency for a specific structure have been approved,
  2 26 additional buildings may be constructed from those same plans
  2 27 and specifications without need of further approval if
  2 28 construction begins within five years of the date of approval.
  2 29 Alterations of a structure which has been previously approved
  2 30 shall not require a review because of these changes, provided
  2 31 the basic structure remains unchanged.  On or before December
  2 32 31, 2008, each governmental subdivision of the state shall
  2 33 report to the commissioner on the status of the governmental
  2 34 subdivision's efforts to enforce applicable energy efficiency
  2 35 standards.
  3  1                           EXPLANATION
  3  2    This bill requires the state building code commissioner to
  3  3 adopt as part of the state building code a requirement that
  3  4 all construction must comply with energy conservation
  3  5 requirements.  The bill allows the state building code
  3  6 commissioner to provide training to builders, contractors, and
  3  7 other interested persons on the adopted energy conservation
  3  8 requirements.
  3  9    The bill consolidates the thermal and lighting efficiency
  3 10 standards provisions.  Provisions of the state building code
  3 11 establishing thermal and lighting efficiency energy
  3 12 conservation standards shall be applicable to all new
  3 13 construction owned by the state, an agency of the state, or a
  3 14 political subdivision of the state, to all new construction
  3 15 located in a governmental subdivision which has adopted either
  3 16 the state building code or a local building code or
  3 17 compilation of requirements for building construction, and to
  3 18 all other new construction in the state.
  3 19    The bill requires that all buildings constructed after July
  3 20 1, 2008, comply with applicable energy efficiency standards.
  3 21 A registered architect or registered engineer must review the
  3 22 specifications for compliance with applicable energy
  3 23 efficiency standards.  A statement that a review has been
  3 24 accomplished and that the design is in compliance with the
  3 25 energy efficiency standards must be signed and sealed by the
  3 26 responsible registered architect or registered engineer.  This
  3 27 statement must be filed with the commissioner prior to
  3 28 construction.
  3 29    The bill also requires that on or before December 31, 2008,
  3 30 each city and county report to the state building code
  3 31 commissioner on the status of efforts taken to enforce
  3 32 applicable energy efficiency standards.
