1 An Act establishing energy efficiency performance standards
2 applicable to specified public utilities.

1 1 Section 1. Section 476.6, subsection 16, paragraph b, Code
1 2 2007, is amended to read as follows:
1 3 b. A gas and electric utility required to be
1 4 rate=regulated under this chapter shall assess potential
1 5 energy and capacity savings available from actual and
1 6 projected customer usage by applying commercially available
1 7 technology and improved operating practices to energy=using
1 8 equipment and buildings. The utility shall submit the
1 9 assessment to the board. Upon receipt of the assessment, the
1 10 board shall consult with the department of natural resources
1 11 to develop specific capacity and energy savings performance
1 12 standards for each utility. The standards shall provide for a
1 13 minimum of a twelve percent reduction in the consumption of
1 14 electricity and natural gas attributable to utilization of
1 15 energy savings technology and improved operating practices by
1 16 2012 when compared to consumption levels on July 1, 2007, and
1 17 a twenty percent reduction in consumption attributable to
1 18 utilization of energy savings technology and improved
1 19 operating practices by 2020 when compared to consumption
1 20 levels on July 1, 2007. A utility may include energy savings
1 21 achieved through implementation of energy efficiency measures
1 22 and programs prior to the effective date of this Act in
1 23 achieving the percentage reduction in consumption standards
1 24 pursuant to this paragraph. The utility shall submit an
1 25 energy efficiency plan which shall include economically
1 26 achievable programs designed to attain these energy and
1 27 capacity performance standards.
1 28 EXPLANATION
1 29 This bill relates to the development of energy savings
1 30 performance standards applicable to an electric and natural
1 31 gas utility required to be rate=regulated pursuant to Code
1 32 chapter 476. Code section 476.6, subsection 16, currently
1 33 requires utilities to develop specific capacity and energy
1 34 savings performance standards. The bill quantifies this
1 35 requirement, providing for a minimum of a 12 percent reduction
2 1 in the consumption of electricity and natural gas attributable
2 2 to utilization of energy savings technology and improved
2 3 operating practices by 2012, and a 20 percent reduction by
2 4 2020 when compared to energy consumption levels in existence
2 5 on July 1, 2007. The bill provides that to achieve these
2 6 percentages a utility may include energy savings achieved
2 7 through implementation of energy efficiency measures and
2 8 programs prior to the effective date of the Act.
