1 1 Section 1. NEW SECTION. 68B.8 LOBBYING ACTIVITIES BY
1 2 STATE AGENCIES.
1 3 A state agency of the executive branch of state government
1 4 shall not use or permit the use of its public funds for a paid
1 5 advertisement or public service announcement thirty days prior
1 6 to or during a legislative session for the purpose of
1 7 encouraging the passage, defeat, approval, or modification of
1 8 a bill that is being considered or was considered during the
1 9 previous legislative session, by the general assembly.
1 10 Sec. 2. Section 68B.25, Code 2007, is amended to read as
1 11 follows:
1 12 68B.25 ADDITIONAL PENALTY.
1 13 In addition to any penalty contained in any other provision
1 14 of law, a person who knowingly and intentionally violates a
1 15 provision of sections 68B.2A through 68B.7 68B.8, sections
1 16 68B.22 through 68B.24, or sections 68B.35 through 68B.38 is
1 17 guilty of a serious misdemeanor and may be reprimanded,
1 18 suspended, or dismissed from the person's position or
1 19 otherwise sanctioned.
1 20 EXPLANATION
1 21 This bill creates new Code section 68B.8 which prohibits a
1 22 state agency of the executive branch of state government from
1 23 using or permitting the use of its public funds for a paid
1 24 advertisement or public service announcement 30 days prior to
1 25 or during a legislative session for the purpose of encouraging
1 26 the passage, defeat, approval, or modification of a bill that
1 27 is being considered or was considered during the previous
1 28 legislative session, by the general assembly.
1 29 A person who knowingly and intentionally violates the new
1 30 provision is guilty of a serious misdemeanor and may be
1 31 reprimanded, suspended, or dismissed from the person's
1 32 position or otherwise sanctioned.
1 33 A serious misdemeanor is punishable by confinement for not
1 34 more than one year and a fine of at least $315 but not more
1 35 than $1,875.
