  1  1    Section 1.  Section 262.34, Code 2007, is amended by adding
  1  2 the following new subsection:
  1  3    NEW SUBSECTION.  1A.  Notwithstanding the provisions of
  1  4 subsection 1 to the contrary, when the estimated cost of
  1  5 construction, repairs, or improvement of buildings or grounds
  1  6 under charge of the state board of regents exceeds ten million
  1  7 dollars, the board may enter into a design=build contract with
  1  8 a successful bidder subject to the filing requirements in
  1  9 subsection 1.  A design=build contract may provide that design
  1 10 and construction of the project may be in sequential or
  1 11 concurrent phases.  As used in this subsection, "design=build
  1 12 contract" means a single contract providing for both design
  1 13 services and construction services that may include
  1 14 maintenance, operations, preconstruction, and other related
  1 15 services.
  1 16                           EXPLANATION
  1 17    This bill provides that when the estimated cost of
  1 18 construction, repairs, or improvement of buildings or grounds
  1 19 under charge of the state board of regents exceeds $10
  1 20 million, the board may enter into a design=build contract with
  1 21 a successful bidder.  A design=build contract may provide that
  1 22 design and construction of the project may be in sequential or
  1 23 concurrent phases.  The bill defines "design=build contract"
  1 24 as a single contract providing for both design services and
  1 25 construction services that may include maintenance,
  1 26 operations, preconstruction, and other related services.
