  1 An Act concerning the training and certification of designated
  2    security personnel working at commercial establishments with a
  3    liquor control license or wine or beer permit.

  1  1    Section 1.  Section 123.32, subsection 4, Code 2007, is
  1  2 amended to read as follows:
  1  3    4.  SECURITY EMPLOYEE TRAINING.  A local authority, as a
  1  4 condition of obtaining and holding a license or permit for
  1  5 on=premises consumption, may require a all licensees or
  1  6 permittees to provide that one or more of their designated
  1  7 security employee employees, as defined in section 123.3, to
  1  8 be trained and certified in security methods within four weeks
  1  9 of hire, or within eight weeks of hire if the newly hired
  1 10 designated security employee works in tandem with a designated
  1 11 security employee who is trained and certified.  However, a
  1 12 licensee or permittee who charges or collects an admission or
  1 13 cover charge to enter the premises or attend a performance or
  1 14 program on the premises shall have at least one designated
  1 15 security employee, who shall be designated as the supervising
  1 16 security person, who is trained and certified in security
  1 17 methods, on the premises during the event for which an
  1 18 admission or a cover charge is charged or collected while
  1 19 alcoholic beverages are served or made available to patrons.
  1 20 If training is required, the training shall be through a
  1 21 program authorized by the administrator.  The training shall
  1 22 include but is not limited to mediation techniques, civil
  1 23 rights or unfair practices awareness as provided in section
  1 24 216.7, and providing instruction on the proper physical
  1 25 restraint methods used against a person who has become
  1 26 combative.  A designated security employee trained and
  1 27 certified in security methods as provided in this subsection
  1 28 shall only be required to be trained and certified once to
  1 29 work in a security position in any capacity at any commercial
  1 30 establishment licensed or permitted under this chapter.  The
  1 31 division shall make reasonable efforts to apprise potential
  1 32 licensees and permittees of the requirements of this
  1 33 subsection.
  1 34                           EXPLANATION
  1 35    This bill allows cities and counties to require all liquor
  2  1 control licensees and beer and wine permittees to provide that
  2  2 one or more of their designated security employees who work at
  2  3 their commercial establishments be trained and certified in
  2  4 security methods within a designated period of time after
  2  5 hire.  The training provided must be through a program
  2  6 authorized by the administrator of the alcoholic beverages
  2  7 division of the department of commerce.  Specific requirements
  2  8 for having trained security employees on duty apply to
  2  9 commercial establishments collecting an admission or cover
  2 10 charge to enter the premises while alcoholic beverages are
  2 11 made available.
