  1 An Act relating to notice of meetings of the board of township
  2    trustees.

  1  1    Section 1.  Section 359.17, Code 2007, is amended to read
  1  2 as follows:
  1  3    359.17  TRUSTEES == DUTIES == MEETINGS.
  1  4    1.  The board of township trustees in each township shall
  1  5 consist of three registered voters of the township.  However,
  1  6 in townships with a taxable valuation for property tax
  1  7 purposes of two hundred fifty million dollars or more, the
  1  8 board of township trustees shall consist of five registered
  1  9 voters of the township.  The trustees shall act as fence
  1 10 viewers and shall perform other duties assigned them by law.
  1 11 The board of trustees shall meet not less than two times a
  1 12 year.  At least one of the meetings shall be scheduled to meet
  1 13 the requirements of section 359.49.
  1 14    2.  The trustees may give notice of a meeting of the board
  1 15 of township trustees.  If the trustees choose to give notice
  1 16 of a meeting, the notice shall give the time, date, and place
  1 17 of the meeting and its tentative agenda.  The notice shall be
  1 18 posted at the building in which the meeting is to be held at
  1 19 least twenty=four hours prior to the commencement of the
  1 20 meeting.  After the notice has been posted, the township clerk
  1 21 shall send a copy of the notice to the county auditor.  The
  1 22 clerk shall note on the copy the time and date the notice was
  1 23 posted and the place where the notice was posted.
  1 24  If the trustees choose not to give notice of a meeting, the
  1 25 trustees shall not be eligible to receive compensation for the
  1 26 time spent attending a meeting.  Compensation for the time
  1 27 spent attending a meeting shall not be paid to the trustees by
  1 28 the county board of supervisors unless the county auditor
  1 29 verifies that notice containing the required information was
  1 30 posted at the proper place in a timely manner.
  1 31    Sec. 2.  Section 359.46, subsection 1, Code 2007, is
  1 32 amended by adding the following new paragraph:
  1 33    NEW PARAGRAPH.  c.  When the trustees do not give notice of
  1 34 a meeting as provided in section 359.17, subsection 2.
  1 35                           EXPLANATION
  2  1    This bill provides that the board of township trustees may
  2  2 give notice of the time, date, and place of each meeting, and
  2  3 its tentative agenda.  If the trustees choose to give notice,
  2  4 the trustees shall post a notice of a meeting at the building
  2  5 in which the meeting is to be held, and a copy of the notice
  2  6 must be sent to the county auditor.  If the trustees choose
  2  7 not to give notice of a meeting, the county board of
  2  8 supervisors shall not pay the trustees for the time spent
  2  9 attending the meeting.
