1 1 Section 1. INTERIM STUDY COMMITTEE == REAL ID
1 2 IMPLEMENTATION. The legislative council is requested to
1 3 establish an interim study committee to consider the issues
1 4 associated with the federal REAL ID Act of 2005. The interim
1 5 committee shall consider procedures to be developed by the
1 6 department of transportation for issuance of REAL ID compliant
1 7 driver's licenses and nonoperator's identification cards,
1 8 including but not limited to security procedures, verification
1 9 of identifying information of applicants, and revisions to the
1 10 driver's license and nonoperator's identification card issued;
1 11 attempt to identify start=up costs and ongoing expenses
1 12 associated with implementation of requirements of the REAL ID
1 13 Act; and examine the impact of REAL ID implementation on the
1 14 citizens of Iowa and consider how failure to implement REAL ID
1 15 would impact the state and its citizens. In addition, the
1 16 interim committee may consider any issues the committee deems
1 17 relevant to the state's decision regarding the REAL ID Act.
1 18 If established, the interim committee shall submit a report
1 19 with its findings and recommendations to the general assembly
1 20 on or before January 1, 2009.
1 21 EXPLANATION
1 22 This bill requests the legislative council to establish an
1 23 interim study committee to consider issues associated with the
1 24 federal REAL ID Act of 2005.
1 25 The REAL ID Act was passed on May 11, 2005, as part of the
1 26 federal Emergency Supplemental Appropriations Act for Defense,
1 27 the Global War on Terror, and Tsunami Relief, 2005. The REAL
1 28 ID Act creates national standards for issuance of driver's
1 29 licenses and identification cards, and provides that on and
1 30 after May 11, 2008, a state's driver's licenses and
1 31 identification cards must be in compliance with the REAL ID
1 32 standards in order to be accepted as proof of identity for
1 33 official federal purposes, such as boarding a federally
1 34 regulated commercial aircraft or entering certain federal
1 35 facilities. Proposed federal regulations allow the United
2 1 States department of homeland security to grant an extension
2 2 of the deadline for compliance through December 31, 2010. A
2 3 second extension may be granted if the state meets certain
2 4 benchmarks established by the department. The federal
2 5 regulations allow a five=year phase=in of REAL ID
2 6 implementation for states that have been granted an extension.
2 7 The interim study committee requested under the bill would
2 8 consider procedures to be developed by the state department of
2 9 transportation for issuance of REAL ID compliant driver's
2 10 licenses and nonoperator's identification cards, costs
2 11 associated with implementation of REAL ID Act requirements,
2 12 the impact of REAL ID implementation on Iowa citizens, how
2 13 failure to implement REAL ID would affect the state and its
2 14 citizens, and any other issues deemed relevant to the state's
2 15 decision regarding the REAL ID Act. The interim committee, if
2 16 established, is required to submit a report with its findings
2 17 and recommendations to the general assembly by January 1,
2 18 2009.
