  1  1    Section 1.  Section 249A.30A, Code Supplement 2007, is
  1  2 amended to read as follows:
  1  3    249A.30A  MEDICAL ASSISTANCE == PERSONAL NEEDS ALLOWANCE.
  1  4    The personal needs allowance under the medical assistance
  1  5 program, which may be retained by a resident of a nursing
  1  6 facility, an intermediate care facility for persons with
  1  7 mental retardation, or an intermediate care facility for
  1  8 persons with mental illness, as defined in section 135C.1, or
  1  9 who is a resident of a psychiatric medical institution for
  1 10 children as defined in section 135H.1, shall be fifty dollars
  1 11 per month.  A resident of a nursing facility, an intermediate
  1 12 care facility for persons with mental retardation, or an
  1 13 intermediate care facility for persons with mental illness who
  1 14 has income of less than fifty dollars per month shall receive
  1 15 a supplement from the state in the amount necessary to receive
  1 16 a personal needs allowance of fifty dollars per month, if
  1 17 funding is specifically appropriated for this purpose.
  1 18                           EXPLANATION
  1 19    This bill relates to the personal needs allowance for
  1 20 residents of nursing facilities, intermediate care facilities
  1 21 for persons with mental retardation, intermediate care
  1 22 facilities for persons with mental illness, and psychiatric
  1 23 medical institutions for children.  The existing personal
  1 24 needs allowance amount is $50 per month.  The bill provides
  1 25 that a resident of a nursing facility, an intermediate care
  1 26 facility for persons with mental retardation, or an
  1 27 intermediate care facility for persons with mental illness,
  1 28 who has income of less than $50 per month shall receive a
  1 29 supplement from the state in the amount needed to receive a
  1 30 personal needs allowance of $50 per month.  Prior law allowed
  1 31 for the supplement only if funding was specifically
  1 32 appropriated for this purpose.
