1 An Act relating to the disposal and recycling of waste oil
2 filters and establishing a fee.

1 1 Section 1. Section 455D.13, Code 2007, is amended to read
1 2 as follows:
1 3 455D.13 LAND DISPOSAL OF WASTE OIL AND WASTE OIL FILTERS
1 4 PROHIBITED == COLLECTION AND RECYCLING.
1 5 1. A sanitary landfill shall not accept waste oil for
1 6 final disposal beginning July 1, 1990. Beginning July 1,
1 7 2008, a sanitary landfill shall not accept waste oil filters
1 8 for final disposal.
1 9 2. A person offering for sale or selling oil or oil
1 10 filters at retail in the state shall do the following:
1 11 a. Accept at the point of sale, waste oil and waste oil
1 12 filters from customers, or post notice of locations where a
1 13 customer may dispose of waste oil and waste oil filters.
1 14 b. Post written notice that it is unlawful to dispose of
1 15 waste oil and waste oil filters in a sanitary landfill.
1 16 Sec. 2. NEW SECTION. 455D.13A WASTE OIL FILTER
1 17 RECYCLING.
1 18 1. As used in this section, unless the context otherwise
1 19 requires:
1 20 a. "Collection site" means a vendor, waste oil collector,
1 21 waste oil filter collector, or waste oil filter recycler that
1 22 accepts waste oil filters from a person.
1 23 b. "Vendor" means a person offering for sale or selling
1 24 oil filters.
1 25 c. "Waste oil collector" means a person that collects
1 26 waste oil or a waste oil filter from a collection site,
1 27 extracts used oil, and delivers the waste oil filter to a
1 28 waste oil filter recycler.
1 29 d. "Waste oil filter collector" means a person that
1 30 collects waste oil filters from a collection site for delivery
1 31 to a waste oil filter recycler or a waste oil collector.
1 32 e. "Waste oil filter recycler" means a person that
1 33 processes waste oil filters into scrap steel by shredding or
1 34 compacting and cleaning away oil residue by a chemical or
1 35 pyrolysis process and recycles the component materials
2 1 including waste oil.
2 2 2. A waste oil collector or waste oil filter collector
2 3 that collects waste oil filters from a collection site shall
2 4 do all of the following:
2 5 a. Identify in writing any waste oil collector or waste
2 6 oil filter recycler to which waste oil filters are delivered.
2 7 b. Provide a receipt to a collection site for any waste
2 8 oil filter collected. The receipt shall include a statement
2 9 identifying any end buyer of waste oil filters or the recycled
2 10 oil filter components including the waste oil.
2 11 c. Provide a waste oil filter recycler or waste oil
2 12 collector with a copy of the receipt provided to the
2 13 collection site from which the waste oil filter was received.
2 14 3. A collection site shall post written notice identifying
2 15 all waste oil filter collectors, waste oil collectors, and
2 16 waste oil filter recyclers servicing the collection site.
2 17 4. A waste oil collector or waste oil filter recycler
2 18 shall report annually to the department any buyer of waste oil
2 19 filters and recycled oil filter components.
2 20 5. A receipt received by a collection site shall be kept
2 21 on file by the collection site for a period of five years.
2 22 6. A collection site shall be registered with the
2 23 department through a permitting process administered by the
2 24 department. The department shall not charge a permitting fee
2 25 or any similar fee during the permitting process.
2 26 7. A collection site may charge a recycling fee not to
2 27 exceed one dollar and fifty cents per waste oil filter
2 28 received by the collection site.
2 29 8. A collection site shall comply with all rules and
2 30 regulations relating to the collection, transportation,
2 31 storage, and handling of waste oil and waste oil filters.
2 32 9. A collection site shall give preference to an Iowa=
2 33 based business when the price for waste oil filter related
2 34 goods and services is within ten percent of the price offered
2 35 by a business based outside the state.
3 1 EXPLANATION
3 2 This bill relates to the disposal and recycling of waste
3 3 oil filters.
3 4 The bill prohibits the land disposal of waste oil filters
3 5 beginning July 1, 2008. The bill also provides that the
3 6 notice and collection requirements for waste oil filters are
3 7 the same as for waste oil.
3 8 The bill provides for the collection and recycling of waste
3 9 oil filters. The bill provides that a waste oil collector or
3 10 waste oil filter collector that collects a waste oil filter
3 11 from a collection site shall provide the collection site with
3 12 a receipt and identification of persons to which the waste oil
3 13 filters are delivered. A copy of the receipt must be given to
3 14 a person to which the waste oil filters are delivered. The
3 15 bill requires that the receipts must be retained for a period
3 16 of five years.
3 17 The bill provides that a collection site shall post notice
3 18 identifying persons collecting waste oil filters from the
3 19 collection site.
3 20 The bill provides for a permitting process administered by
3 21 the department of natural resources to register collection
3 22 sites.
3 23 The bill provides that a collection site may charge a
3 24 recycling fee not to exceed $1.50 per waste oil filter
3 25 received by the collection site.
3 26 The bill provides that a collection site shall give
3 27 preference to an Iowa=based business when the price for waste
3 28 oil filter related goods and services is within 10 percent of
3 29 the price offered by a business based outside the state.
