  1  1    Section 1.  Section 8.36A, Code 2007, is amended by adding
  1  2 the following new subsection:
  1  3    NEW SUBSECTION.  3.  a.  Unless expressly authorized by
  1  4 law, the total number of full=time equivalent positions funded
  1  5 by the general fund of the state for departments of state
  1  6 government shall not exceed the number of such positions
  1  7 authorized for the fiscal year beginning July 1, 2008.  The
  1  8 number shall be adjusted to reflect the positions approved for
  1  9 conversion from contract positions in accordance with
  1 10 subsection 2.
  1 11    b.  The limitation on the number of positions established
  1 12 pursuant to paragraph "a" may be annually increased as
  1 13 provided in this paragraph.  The annual increase in the
  1 14 limitation shall not exceed the percentage increase in the
  1 15 state's population as compared to the previous year.  The
  1 16 population figures used to make the comparison shall be those
  1 17 published in the latest preceding certified federal census or
  1 18 the most recent population estimate issued by the United
  1 19 States bureau of the census, whichever is the most recent.
  1 20 The limitation increase shall be annually identified by the
  1 21 department of management for the succeeding fiscal year on or
  1 22 before the date of the revenue estimating conference's
  1 23 December meeting held in accordance with section 8.22A,
  1 24 subsection 3.
  1 25                           EXPLANATION
  1 26    This bill limits the total number of full=time equivalent
  1 27 positions authorized for state government departments that are
  1 28 funded from the general fund of the state.  Under Code section
  1 29 8.2, the term "department" refers to the departments and
  1 30 agencies of the executive branch.
  1 31    The bill amends Code section 8.36A, which under current law
  1 32 specifies how full=time positions are determined and provides
  1 33 that the number authorized for a department can be adjusted to
  1 34 reflect conversion of contract positions to state employee
  1 35 positions.  According to the bill, the base limitation is
  2  1 equal to the total number of full=time equivalent positions
  2  2 authorized for fiscal year 2008=2009.  The base limitation is
  2  3 subject to adjustment for contract positions converted.  In
  2  4 addition, the limitation may be annually increased by not more
  2  5 than the percentage increase in the state's population as
  2  6 compared to the previous year.  The increase is identified
  2  7 annually by the department of management for the succeeding
  2  8 fiscal year on or before the date of the revenue estimating
  2  9 conference's meeting required to be held by December 15 to
  2 10 agree to a revenue estimate for the succeeding fiscal year.
