NEW SECTION. 135.154 LEGISLATIVE FINDINGS AND 1 2 INTENT. 1 3 The general assembly recognizes research indicating that 1 4 the application of information technology such as electronic 1 5 medical records, computer=based physician order entry, and 1 6 electronic data interchange has significant potential for 1 7 improving health care quality and safety and obtaining 1 8 efficiencies in the health care delivery system. The general 1 9 assembly also recognizes that these efficiencies can be 1 10 significantly improved if there are statewide standards to 1 11 enable the sharing of information among health care payers, 1 12 providers, consumers, and governmental entities. The state 1 13 has an interest in designing and implementing a statewide 1 14 interoperable health care information infrastructure that 1 15 includes standards for administrative data exchange, clinical 1 16 support programs, quality performance measures, and the 1 17 maintenance of the security and confidentiality of individual 1 18 patient data. It is the intent of the general assembly to 1 19 promote the implementation and development of this 1 20 infrastructure by establishing a health care information 1 21 technology and infrastructure advisory committee to assist in 1 22 the development of a health care information technology 1 23 strategic plan. 1 24 Sec. 2. NEW SECTION. 135.155 HEALTH CARE INFORMATION 1 25 TECHNOLOGY AND INFRASTRUCTURE ADVISORY COMMITTEE == DUTIES. 1 26 1. a. The department shall establish a health care 1 27 information technology and infrastructure advisory committee. 1 28 Members shall be appointed by the director of public health 1 29 and shall include representatives of the department of human 1 30 services, licensed hospitals and other licensed health care 1 31 facilities or providers, licensed health care professionals, 1 32 institutions of higher education in the state, health insurers 1 33 and health maintenance organizations, and other parties with 1 34 an interest and expertise in health care information 1 35 technology. Members shall serve staggered terms of two years. 2 1 Appointments of members of the committee shall comply with 2 2 sections 69.16 and 69.16A. Vacancies shall be filled by the 2 3 original appointing authority and in the manner of the 2 4 original appointment. Members shall receive actual expenses 2 5 incurred while serving in their official capacity and may also 2 6 be eligible to receive compensation as provided in section 2 7 7E.6. The committee shall annually select a chairperson from 2 8 its membership. A majority of the members of the committee 2 9 shall constitute a quorum. 2 10 2. The advisory committee shall assist the department in 2 11 all of the following activities: 2 12 a. Development of a health care information technology 2 13 strategic plan. The strategic plan shall include an inventory 2 14 and assessment of existing health care information technology 2 15 infrastructure and systems and shall identify the required 2 16 steps to develop a statewide interoperable health care 2 17 information infrastructure within a ten=year time frame. The 2 18 steps identified shall include estimates of necessary 2 19 financial resources for development of the infrastructure and 2 20 for determining standards for development of administrative 2 21 data exchange, clinical support systems, data warehousing, 2 22 smart cards, personal medical records, and the maintenance of 2 23 the security and confidentiality of individual patient data. 2 24 The plan shall be submitted by the director to the governor 2 25 and the general assembly by January 1, 2009. 2 26 b. Plan implementation, including the promulgation of 2 27 rules regarding application of the standards identified in 2 28 paragraph "a" to hospitals, nursing homes, and other licensed 2 29 health care facilities and education organizations and 2 30 identification of potential sources of financial assistance to 2 31 such entities and organizations relating to that application. 2 32 c. Preparation of an annual report, to be submitted by the 2 33 director to the governor and the general assembly by January 2 34 1, providing a status report regarding plan development and 2 35 implementation. The report shall detail progress made during 3 1 the previous year, itemize expenditures of any appropriated 3 2 funds, and make a recommendation regarding the amount of 3 3 funding necessary to fully implement the plan and establish 3 4 the infrastructure. 3 5 Sec. 3. HEALTH CARE INFORMATION TECHNOLOGY AND 3 6 INFRASTRUCTURE ADVISORY COMMITTEE == APPROPRIATION. There is 3 7 appropriated from the general fund of the state to the Iowa 3 8 department of public health for the fiscal year beginning July 3 9 1, 2007, and ending June 30, 2008, the following amount, or so 3 10 much thereof as may be necessary, to be utilized for the 3 11 purpose designated in this section: 3 12 .................................................. $ 300,000 3 13 Amounts appropriated pursuant to this section shall be 3 14 utilized by and in support of the health care information 3 15 technology and infrastructure advisory committee established 3 16 in section 135.155 in the development of a health care 3 17 information technology strategic plan. Notwithstanding 3 18 section 8.33, moneys appropriated in this section that remain 3 19 unencumbered or unobligated at the close of the fiscal year 3 20 shall not revert but shall remain available for expenditure 3 21 for the purpose designated until the close of the succeeding 3 22 fiscal year. 3 23 EXPLANATION 3 24 This bill provides for the establishment of a health care 3 25 information technology and infrastructure advisory committee. 3 26 The committee shall provide assistance to the Iowa department 3 27 of public health in developing a health care information 3 28 technology strategic plan relating to the establishment of a 3 29 statewide interoperable health care information infrastructure 3 30 within a 10=year period. 3 31 The bill provides that members of the advisory committee 3 32 shall be appointed by the director and shall include 3 33 representatives of the department of human services, licensed 3 34 hospitals and other licensed health care facilities or 3 35 providers, licensed health care professionals, institutions of 4 1 higher education in the state, health insurers and health 4 2 maintenance organizations, and other parties with an interest 4 3 and expertise in health care information technology. The bill 4 4 specifies provisions relating to membership appointment, 4 5 terms, and compensation. 4 6 The bill provides that the advisory committee shall assist 4 7 the department in developing a health care information 4 8 technology strategic plan that includes an inventory and 4 9 assessment of existing health care information technology 4 10 infrastructure and systems and identifies the required steps 4 11 to develop a statewide interoperable health care information 4 12 infrastructure within a 10=year time frame. The bill provides 4 13 that the plan shall be submitted by the director to the 4 14 governor and the general assembly by January 1, 2009. The 4 15 bill provides that the committee shall additionally assist 4 16 with plan implementation, including the promulgation of rules 4 17 regarding application of the identified standards to 4 18 hospitals, nursing homes, and other licensed health care 4 19 facilities and education organizations and identification of 4 20 potential sources of financial assistance to such entities and 4 21 organizations relating to that application. The bill provides 4 22 that the committee shall also assist in the preparation of an 4 23 annual report, to be submitted by the director to the governor 4 24 and the general assembly by January 1, providing a status 4 25 report regarding plan development and implementation. 4 26 The bill provides for an appropriation from the general 4 27 fund of the state to the department of public health for the 4 28 fiscal year beginning July 1, 2007, and ending June 30, 2008, 4 29 of $300,000 for utilization by and in support of the 4 30 committee, and provides for nonreversion of the funds. 4 31 LSB 2034HH 82 4 32 nh:sc/es/88
