  1  1    Section 1.  Section 716.7, subsection 2, Code Supplement
  1  2 2007, is amended by adding the following new paragraph:
  1  3    NEW PARAGRAPH.  f.  Entering or remaining upon a racetrack
  1  4 enclosure, excursion gambling boat, or any other facility
  1  5 licensed under chapter 99D or 99F if the person has been
  1  6 voluntarily excluded for life from such property pursuant to a
  1  7 process required to be established under section 99D.7,
  1  8 subsection 22, and section 99F.4, subsection 22.
  1  9                           EXPLANATION
  1 10    This bill provides that trespass includes entering or
  1 11 remaining upon a racetrack enclosure, excursion gambling boat,
  1 12 or any other facility licensed under Code chapter 99D or 99F
  1 13 if the person has been voluntarily excluded for life from such
  1 14 property.  Code sections 99D.7 and 99F.4 require gambling
  1 15 facilities to establish a process for persons to voluntarily
  1 16 exclude themselves from gambling facilities licensed under
  1 17 those two Code chapters.  A person who knowingly trespasses as
  1 18 provided by this bill commits a simple misdemeanor.
