  1  1    Section 1.  Section 422.7, Code Supplement 2007, is amended
  1  2 by adding the following new subsection:
  1  3    NEW SUBSECTION.  41.  Subtract, to the extent not otherwise
  1  4 excluded, active duty pay received by a person in the armed
  1  5 forces of the United States, in the national guard, or in the
  1  6 armed forces military reserve for service performed outside
  1  7 the state on or after January 1, 2008.
  1  8    Sec. 2.  RETROACTIVE APPLICABILITY DATE.  This Act applies
  1  9 retroactively to January 1, 2008, for tax years beginning on
  1 10 or after that date.
  1 11                           EXPLANATION
  1 12    This bill excludes from state individual income tax the
  1 13 amount of any active duty pay received for service outside the
  1 14 state of Iowa on or after January 1, 2008, by an individual
  1 15 serving in the United States armed services, the national
  1 16 guard, or armed forces military reserve.
  1 17    The bill applies retroactively to January 1, 2008, for tax
  1 18 years beginning on or after that date.
