                                      A BILL FOR

  1 An Act to legalize participation in an instructional support
  2    program by the Winterset community school district, and
  3    providing an effective date.
  4    WHEREAS, an instructional support program for the Winterset
  5 community school district ends on June 30, 2006; and
  6    WHEREAS, the Winterset community school district erred in
  7 determining the ending date of the instructional support program;
  8 and
  9    WHEREAS, the boards of directors of the Winterset community
 10 school district did not include a provision for the instructional
 11 support program in its certified budget adopted on April 10,
 12 2006; NOW THEREFORE,
 13 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

  1  1    Section 1.  Notwithstanding any contrary provision in
  1  2 chapter 257 including sections 257.18 through 257.21, if the
  1  3 board of directors of the Winterset community school district
  1  4 adopts a resolution, not later than May 10, 2006, to
  1  5 participate in the instructional support program under
  1  6 sections 257.18 through 257.21, and a petition is not filed
  1  7 within twenty=eight days following the adoption of the
  1  8 resolution by the board, the school district may participate
  1  9 in the instructional support program funded as provided by
  1 10 state law for the fiscal year beginning July 1, 2006 and
  1 11 ending June 30, 2007 to the extent established by the board's
  1 12 resolution.
  1 13    Sec. 2.  This Act, being deemed of immediate importance
  1 14 takes effect on enactment.
  1 15                           EXPLANATION
  1 16    This bill legalizes the action of the Winterset community
  1 17 school district to participate in an instructional support
  1 18 program which includes financing for the fiscal year beginning
  1 19 July 1, 2006, and ending June 30, 2007, notwithstanding that
  1 20 the board of directors did not include a provision for the
  1 21 instructional support program in its certified budget.
