1 1 Section 1. Section 455B.301A, subsection 1, paragraph c,
1 2 Code 2005, is amended to read as follows:
1 3 c. Other approved techniques of solid waste management
1 4 including, but not limited to, combustion Combustion with
1 5 energy recovery,.
1 6 d. Other approved techniques of solid waste management
1 7 including but not limited to combustion for waste disposal,
1 8 and disposal in sanitary landfills.
1 9 Sec. 2. Section 455D.3, subsection 1, unnumbered paragraph
1 10 2, Code 2005, is amended to read as follows:
1 11 Notwithstanding section 455D.1, subsection 6, facilities
1 12 which employ combustion of solid waste with energy recovery
1 13 and refuse=derived fuel, which are included in an approved
1 14 comprehensive plan, and which were in operation prior to July
1 15 1, 1989, may include these processes in the definition of
1 16 recycling for the purpose of meeting the state goal if at
1 17 least thirty=five percent of the waste reduction goal,
1 18 required to be met by July 1, 2000, pursuant to this section,
1 19 is met through volume reduction at the source and recycling
1 20 and reuse, as established pursuant to section 455B.301A,
1 21 subsection 1, paragraphs "a" and "b".
1 22 EXPLANATION
1 23 This bill relates to combustion of solid waste with energy
1 24 recovery.
1 25 Currently, a waste management hierarchy in descending order
1 26 of preference is established as the solid waste management
1 27 policy of the state. The bill places combustion with energy
1 28 recovery as a higher preference above other approved
1 29 techniques of solid waste management, including but not
1 30 limited to combustion for waste disposal and disposal in
1 31 sanitary landfills.
1 32 Currently, facilities which employ combustion of solid
1 33 waste with energy recovery and refuse=derived fuel, which are
1 34 included in an approved comprehensive plan, and which were in
1 35 operation prior to July 1, 1989, may include these processes
2 1 in the definition of "recycling" for the purpose of meeting
2 2 solid waste reduction goals if certain criteria are met. The
2 3 bill eliminates the requirement that such facilities must have
2 4 been in operation prior to July 1, 1989.
