1 1 Section 1. Section 804.29, Code 2005, is amended to read
1 2 as follows:
1 3 804.29 CONFIDENTIALITY.
1 4 All information filed with the court for the purpose of
1 5 securing a warrant for an arrest, including but not limited to
1 6 a citation and affidavits, shall be a confidential record
1 7 until such time as a peace officer has made the arrest and has
1 8 made the officer's return on the warrant. During the period
1 9 of time that information is confidential, it shall be sealed
1 10 by the court and the information contained therein shall not
1 11 be disseminated to any person other than a peace officer,
1 12 employee of a county attorney's office, magistrate, or another
1 13 court employee, in the course of official duties.
1 14 EXPLANATION
1 15 This bill relates to access to confidential information
1 16 used to secure an arrest warrant.
1 17 The bill permits an employee of the county attorney's
1 18 office to have access to confidential arrest warrant
1 19 information prior to the person being arrested. Current law
1 20 limits access to the confidential arrest warrant information
1 21 to a peace officer, magistrate, or other court employees in
1 22 the course of official duties.
