  1  1    Section 1.  Section 257.11, Code Supplement 2005, is
  1  2 amended by adding the following new subsection:
  1  3    NEW SUBSECTION.  5A.  SHARED OPERATIONAL FUNCTIONS ==
  1  4 INCREASED STUDENT OPPORTUNITIES.
  1  5    a.  In order to provide additional funding to increase
  1  6 student opportunities for school districts that share
  1  7 operational functions, a supplementary weighting plan for
  1  8 determining enrollment is adopted.  A supplementary weighting
  1  9 of two hundredths per pupil shall be assigned to pupils
  1 10 enrolled in a district that shares with one or more other
  1 11 districts one or more operational functions in the areas of
  1 12 business management, human resources, transportation, or
  1 13 operation and maintenance for at least twenty percent of the
  1 14 school year.  The additional weighting shall be assigned for
  1 15 each discrete operational function shared.
  1 16    b.  The minimum amount of additional weighting for which a
  1 17 school district shall be eligible is an amount corresponding
  1 18 to ten additional pupils, and the maximum amount of additional
  1 19 weighting for which a school district shall be eligible is an
  1 20 amount corresponding to forty additional pupils.  Criteria for
  1 21 determining qualification of operational functions for
  1 22 additional weighting shall be determined by the department of
  1 23 education by rule.
  1 24    Sec. 2.  SHARED OPERATIONAL FUNCTIONS == SUPPLEMENTARY
  1 25 WEIGHTING == APPROPRIATION.  For the fiscal year beginning
  1 26 July 1, 2006, and ending June 30, 2007, there is appropriated
  1 27 from the general fund of the state to the department of
  1 28 education the following amount, or so much thereof as is
  1 29 necessary, to be utilized for the purpose designated in this
  1 30 section:
  1 31 .................................................. $  6,100,000
  1 32    The funds appropriated pursuant to this section shall be
  1 33 allocated on or about November 15, 2006, to school districts
  1 34 that have established shared operational functions pursuant to
  1 35 section 257.11, subsection 5A.  If the amount appropriated is
  2  1 insufficient to fully fund the amount of supplementary
  2  2 weighting requested and approved, the funds shall be allocated
  2  3 to each requesting and approved school district based on the
  2  4 ratio that each district's actual enrollment bears to the
  2  5 total actual enrollment of all requesting and approved school
  2  6 districts.  Notwithstanding section 8.33, moneys appropriated
  2  7 in this section that remain unencumbered or unobligated at the
  2  8 close of the fiscal year shall not revert but shall remain
  2  9 available for expenditure for the purpose designated in this
  2 10 section until the close of the succeeding fiscal year.
  2 11    Sec. 3.  EFFECTIVE DATE.  This Act, being deemed of
  2 12 immediate importance, takes effect upon enactment, and first
  2 13 applies to supplementary weighting for the school year
  2 14 beginning July 1, 2006.
  2 15                           EXPLANATION
  2 16    This bill provides for the establishment of a new category
  2 17 of supplementary weighting relating to shared school
  2 18 operational functions.
  2 19    The bill provides that supplementary weighting shall be
  2 20 available to increase student opportunities for school
  2 21 districts that share operational functions.  The bill provides
  2 22 that a supplementary weighting of .02 per pupil shall be
  2 23 assigned to pupils enrolled in a district that shares one or
  2 24 more operational functions in the areas of business
  2 25 management, human resources, transportation, or operation and
  2 26 maintenance for a minimum of 20 percent of the school year and
  2 27 shall be assigned for each discrete operational function
  2 28 shared.  The bill provides that the minimum amount of
  2 29 additional weighting for which a school district shall be
  2 30 eligible is an amount corresponding to 10 additional pupils,
  2 31 and the maximum is an amount corresponding to 40 additional
  2 32 pupils.  The bill provides that criteria for determining
  2 33 qualification of operational functions for additional
  2 34 weighting shall be determined by the department of education
  2 35 by rule.
  3  1    The bill appropriates $6.1 million from the state general
  3  2 fund to the department of education to be allocated on or
  3  3 about November 15, 2006, to school districts which have
  3  4 established shared operational functions, provides for
  3  5 nonreversion of the funds for one year, and provides for
  3  6 allocation among all requesting and approved school districts
  3  7 if the amount appropriated is insufficient to fully fund the
  3  8 amounts requested and approved based on the ratio that each
  3  9 requesting and approved school district's actual enrollment
  3 10 bears to the total actual enrollment of all requesting and
  3 11 approved school districts.
  3 12    The bill takes effect upon enactment and first applies to
  3 13 supplementary weighting for the school year beginning July 1,
  3 14 2006.
