1 An Act revising the membership requirements for the child
2 advocacy board.

1 1 Section 1. Section 237.16, subsections 1 and 3, Code 2005,
1 2 are amended to read as follows:
1 3 1. The child advocacy board is created within the
1 4 department of inspections and appeals. The state board
1 5 consists of nine members appointed by the governor, subject to
1 6 confirmation by the senate and directly responsible to the
1 7 governor. One member shall be an active court appointed
1 8 special advocate volunteer, one member shall be an active
1 9 member of a local citizen foster care review board, and one
1 10 member shall be a judicial branch employee or judicial officer
1 11 appointed from nominees submitted by the judicial branch. The
1 12 appointment is for a term of four years that begins and ends
1 13 as provided in section 69.19. Vacancies on the state board
1 14 shall be filled in the same manner as original appointments
1 15 are made.
1 16 3. An employee of the department or of the department of
1 17 inspections and appeals, an employee of a child=placing
1 18 agency, an employee of an agency with which the department
1 19 contracts for services for children under foster care, a
1 20 foster parent providing foster care, or an employee of the
1 21 district court is not eligible to serve on the state board.
1 22 However, the judicial branch employee or judicial officer
1 23 appointed from nominees submitted by the judicial branch in
1 24 accordance with subsection 1 shall be eligible to serve on the
1 25 state board.
1 26 EXPLANATION
1 27 This bill amends Code section 237.16, relating to the
1 28 membership of the child advocacy board. Current law provides
1 29 for the board to have nine members, with two members
1 30 designated to represent particular interests. The bill
1 31 specifies that one of the nine members must be an active
1 32 member of a local citizen foster care review board. The bill
1 33 also eliminates restrictions against the following persons
1 34 serving as members of the child advocacy board: an employee
1 35 of a child=placing agency, an employee of an agency with which
2 1 the department contracts for services for children under
2 2 foster care, and a foster parent providing foster care.
