  1  1    Section 1.  Section 904.703, subsection 3, Code 2005, is
  1  2 amended to read as follows:
  1  3    3.  An inmate labor fund is established under the control
  1  4 of the department.  All fees, grants, appropriations, or
  1  5 reimbursed costs received by the department and related to
  1  6 inmate labor shall be deposited into the fund, and the moneys
  1  7 shall be used by the department to offset staff and
  1  8 transportation costs related to providing inmate labor to
  1  9 public entities and to initiate or supplement other inmate
  1 10 labor activities within correctional institutions or
  1 11 throughout the state.  Notwithstanding section 8.33, moneys
  1 12 remaining in the fund at the end of a fiscal year shall not
  1 13 revert to the general fund of the state.  Notwithstanding
  1 14 section 12C.7, interest and earnings deposited in the fund
  1 15 shall be credited to the fund.
  1 16                           EXPLANATION
  1 17    This bill relates to the use of moneys deposited into the
  1 18 inmate labor fund.  The bill permits moneys in the fund to be
  1 19 used by the department of corrections to initiate or
  1 20 supplement inmate labor activities within correctional
  1 21 institutions or throughout the state.  Current law provides
  1 22 that moneys in the fund be used to offset staff and
  1 23 transportation costs related to providing inmate labor to
  1 24 public entities.
