1 An Act relating to requirements for the issuance of driver's
2 licenses to foreign nationals.
3 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

1 1 Section 1. Section 321.182, subsection 1, paragraph a,
1 2 Code 2005, is amended to read as follows:
1 3 a. Make application on a form provided by the department
1 4 which shall include the applicant's full name, signature,
1 5 current mailing address, current residential address, date of
1 6 birth, social security number, and physical description
1 7 including sex, height, and eye color. The application may
1 8 contain other information the department may require by rule.
1 9 following:
1 10 (1) The applicant's full name.
1 11 (2) The applicant's signature.
1 12 (3) The applicant's current residential address.
1 13 (4) The applicant's current mailing address.
1 14 (5) The applicant's date of birth.
1 15 (6) A physical description of the applicant, including
1 16 sex, height, and eye color.
1 17 (7) The applicant's social security number or, if the
1 18 applicant does not have a social security number, an
1 19 individual taxpayer identification number issued by the
1 20 internal revenue service. Pursuant to procedures established
1 21 by the department and for an applicant who is a foreign
1 22 national temporarily present in this state, the department may
1 23 waive the requirement that the application include the
1 24 applicant's social security number or taxpayer identification
1 25 number.
1 26 (8) Other acceptable forms of identification as determined
1 27 by the department by rule, including documents issued in a
1 28 jurisdiction outside the United States, for the purpose of
1 29 establishing the identity of an applicant who is a foreign
1 30 national.
1 31 Sec. 2. Section 321.190, subsection 1, paragraph d,
1 32 unnumbered paragraph 1, Code 2005, is amended to read as
1 33 follows:
1 34 The fee for a nonoperator's identification card shall be
1 35 five dollars and the card shall be valid for a period of five
2 1 years from the date of issuance. A nonoperator's
2 2 identification card shall be issued without expiration to
2 3 anyone age seventy or over. If an applicant for a
2 4 nonoperator's identification card is a foreign national who is
2 5 temporarily present in this state, the nonoperator's
2 6 identification card shall be issued only for valid for the
2 7 lesser of a period of two years or the length of time the
2 8 foreign national is authorized to be present as if determined
2 9 by the department, not to exceed two years. An issuance fee
2 10 shall not be charged for a person whose driver's license or
2 11 driving privilege has been suspended under section 321.210,
2 12 subsection 1, paragraph "c".
2 13 Sec. 3. Section 321.196, subsection 1, Code 2005, is
2 14 amended to read as follows:
2 15 1. Except as otherwise provided, a driver's license, other
2 16 than an instruction permit, chauffeur's instruction permit, or
2 17 commercial driver's instruction permit issued under section
2 18 321.180, expires five years from the licensee's birthday
2 19 anniversary occurring in the year of issuance if the licensee
2 20 is between the ages of seventeen years eleven months and
2 21 seventy years on the date of issuance of the license. If the
2 22 licensee is under the age of seventeen years eleven months or
2 23 age seventy or over, the license is effective for a period of
2 24 two years from the licensee's birthday anniversary occurring
2 25 in the year of issuance. A licensee whose license is
2 26 restricted due to vision or other physical deficiencies may be
2 27 required to renew the license every two years. If a licensee
2 28 is a foreign national who is temporarily present in this
2 29 state, the license shall be issued only for valid for the
2 30 lesser of a period of two years or the length of time the
2 31 foreign national is authorized to be present as if determined
2 32 by the department, not to exceed two years.
2 33 EXPLANATION
2 34 This bill amends the application procedures for issuance of
2 35 a driver's license or nonoperator's identification card. The
3 1 bill provides that an applicant who does not have a social
3 2 security number may substitute a federal individual taxpayer
3 3 identification number on the application. In addition, the
3 4 state department of transportation is required to adopt rules
3 5 that provide for the acceptance of documentation establishing
3 6 the identity of foreign nationals. Documents issued by a
3 7 jurisdiction outside the United States may be accepted as
3 8 proof of identity. The bill specifies that a driver's license
3 9 or nonoperator's identification card issued to a foreign
3 10 national expires at the end of the person's authorized length
3 11 of stay, or in two years, whichever is the shorter period of
3 12 time.
