Section 147.107, subsection 5, Code 2005, is 1 2 amended to read as follows: 1 3 5. Notwithstanding subsection 1 and any other provision of 1 4 this section to the contrary, a physician may delegate the 1 5 function of prescribing drugs, controlled substances, and 1 6 medical devices to a physician assistant licensed pursuant to 1 7 chapter 148C. When delegated prescribing occurs, the 1 8 supervising physician's name shall be used, recorded, or 1 9 otherwise indicated in connection with each individual 1 10 prescription so that the individual who dispenses or 1 11 administers the prescription knows under whose delegated 1 12 authority the physician assistant is prescribing. Rules 1 13 relating to the authority of physician assistants to prescribe 1 14 drugs, controlled substances, and medical devices pursuant to 1 15 this subsection shall be adopted by the board of physician 1 16 assistant examiners, after consultation with the board of 1 17 medical examiners and the board of pharmacy examiners. 1 18However, the rules shall prohibit the prescribing of schedule 1 19 II controlled substances which are listed as stimulants or 1 20 depressants pursuant to chapter 124.1 21 EXPLANATION 1 22 A physician may delegate the function of prescribing drugs 1 23 and controlled substances to a physician assistant, subject to 1 24 rules adopted by the physician assistant examiners board. 1 25 Current law requires that the board rules prohibit the 1 26 prescribing of schedule II controlled substances which are 1 27 listed as stimulants or depressants pursuant to Code chapter 1 28 124. 1 29 This bill strikes that rule requirement. The effect of the 1 30 bill is give the physician assistant examiners board the 1 31 discretion to eliminate the restriction regarding the 1 32 prescribing of such schedule II controlled substances by 1 33 physician assistants in its rules. 1 34 LSB 2441SC 81 1 35 jr:nh/cf/24
