  1  3              ELIMINATION OF REPORTING REQUIREMENT
  1  4    Section 1.  Section 169.5, subsection 7, unnumbered
  1  5 paragraph 3, Code 2005, is amended by striking the unnumbered
  1  6 paragraph.
  1  7                           DIVISION II
  1  8                      PESTICIDE ACT OF IOWA
  1  9    Sec. 2.  Section 206.21, subsection 2, Code 2005, is
  1 10 amended to read as follows:
  1 11    2.  For the purpose of carrying out the provisions and the
  1 12 requirements of this chapter and the rules made adopted and
  1 13 notices given pursuant thereto to this chapter, the secretary
  1 14 or the secretary's authorized agents, inspectors, or employees
  1 15 may enter into or upon any place during reasonable business
  1 16 hours in order to examine pesticide use or take periodic
  1 17 random samples for chemical examinations of pesticides and
  1 18 devices and to open any bundle, package or other container
  1 19 containing or believed to contain a pesticide in order to
  1 20 determine whether the pesticide or device complies with the
  1 21 requirements of this chapter.  Methods of analysis shall be
  1 22 those currently used by the Association association of
  1 23 Official Agricultural Chemists official agricultural chemists.

  1 25          MOTOR VEHICLE FUEL DEALERS == ELIMINATION OF
  1 26              VOLUNTARY SAMPLING PROCEDURE AND FEE
  1 27    Sec. 3.  Section 214A.6, Code 2005, is repealed.
  1 28                           EXPLANATION
  1 29    IOWA BOARD OF VETERINARY MEDICINE == ELIMINATION OF
  1 30 REPORTING REQUIREMENT.  This division amends a provision in
  1 31 Code chapter 169, the Iowa veterinary practice Act.  The Code
  1 32 chapter is administered by the Iowa board of veterinary
  1 33 medicine within the department of agriculture and land
  1 34 stewardship.  The division provides that the president and
  1 35 secretary of the board must submit a report to the governor
  2  1 involving the board's transactions, including financial
  2  2 information.  The division eliminates that requirement.
  2  3    PESTICIDE ACT OF IOWA.  This division amends Code chapter
  2  4 206 which provides for the regulation of pesticides.  Code
  2  5 section 206.21 provides that the department may enter onto a
  2  6 person's premises in order to take samples of chemicals for
  2  7 testing in order to ensure compliance with the provisions of
  2  8 this chapter.  The division provides that the department may
  2  9 also examine pesticide use on the premises.
  2 10    MOTOR VEHICLE FUEL DEALERS == ELIMINATION OF VOLUNTARY
  2 11 SAMPLING PROCEDURE AND FEE.  This division amends Code chapter
  2 12 214A regulating dealers of motor vehicle fuel on a wholesale
  2 13 or retail basis.  The Code chapter provision currently allows
  2 14 a dealer to submit a motor vehicle fuel sample or oxygenate
  2 15 octane enhancer (alcohol) to the department of agriculture and
  2 16 land stewardship for testing.  It prescribes procedures for
  2 17 taking a test sample and delivering it to the department.  The
  2 18 dealer must also submit a statement made under oath by a
  2 19 "reputable" witness and a $2 fee to the department.  The
  2 20 division repeals that provision.
