The following amendment to the Constitution of 1 2 the State of Iowa is proposed: 1 3 Article VII of the Constitution of the State of Iowa is 1 4 amended by adding the following new section: 1 5 SALES AND USE TAX REVENUE INCREASE. SEC. 10. The first 1 6 sixty million dollars of the increase in the state sales and 1 7 use tax revenues received in a fiscal year over the state 1 8 sales and use tax revenues received in the previous fiscal 1 9 year shall be equally dedicated to the following purposes: 1 10 1. One=third, not to exceed twenty million dollars, shall 1 11 be dedicated for water quality initiatives. 1 12 2. One=third, not to exceed twenty million dollars, shall 1 13 be deposited in the fish and game protection fund. 1 14 3. One=third, not to exceed twenty million dollars, shall 1 15 be dedicated to and deposited in the Iowa resource enhancement 1 16 and protection fund or its successor fund as the General 1 17 Assembly may by law provide. 1 18 Use tax revenues do not include any amounts to be credited 1 19 to the road use tax fund or its successor fund as the General 1 20 Assembly may by law provide. 1 21 This section shall be interpreted and implemented to 1 22 achieve its purpose to increase funds available for preserving 1 23 and promoting environmental quality. The General Assembly 1 24 shall enact laws to implement this section. 1 25 Sec. 2. REFERRAL AND PUBLICATION. The foregoing proposed 1 26 amendment to the Constitution of the State of Iowa is referred 1 27 to the General Assembly to be chosen at the next general 1 28 election for members of the General Assembly, and the 1 29 Secretary of State is directed to cause it to be published for 1 30 three consecutive months previous to the date of that election 1 31 as provided by law. 1 32 EXPLANATION 1 33 This joint resolution proposes an amendment to the state 1 34 constitution. The constitutional amendment requires the first 1 35 $60 million of the increase in state sales and use tax 2 1 revenues received in a fiscal year over the amount received in 2 2 the previous fiscal year to be equally dedicated to water 2 3 quality initiatives, deposited in the fish and game protection 2 4 fund, and deposited in the Iowa resource enhancement and 2 5 protection fund. 2 6 Upon passage of the joint resolution, the proposed 2 7 amendment is to be referred to the next general assembly for 2 8 its consideration a second time before it may be submitted to 2 9 the electorate for ratification. 2 10 LSB 5080XS 81 2 11 mg:rj/je/5.1
