  1 1 Section 1. Section 91D.1, subsection 1, paragraph a, Code
1 2 2005, is amended to read as follows:
1 3 a. The hourly wage stated in the federal minimum wage law,
  1 4 pursuant to 29 U.S.C. } 206, shall be increased to $3.85 $6.00
  1 5 on January 1 of 1990 July 1, 2005, $4.25 $6.50 on January 1 of
  1 6 1991 July 1, 2006, and $4.65 $7.00 on January 1 of 1992 July

  1 8 Sec. 2. Section 91D.1, subsection 1, paragraph d, Code
1 9 2005, is amended by striking the paragraph.
  1 10 EXPLANATION
1 11 This bill raises the state's hourly minimum wage each year
1 12 of the next three years to: $6.00 on July 1, 2005, $6.50 on
  1 13 July 1, 2006, and $7.00 on July 1, 2007. The Code currently
1 14 provides for a minimum wage rate of $4.65, but because the
1 15 federal minimum wage laws have primacy over state minimum wage
1 16 laws unless the state sets a higher minimum wage, employers of
1 17 the state must pay the federal hourly rate of $5.15, which
  1 18 took effect September 1, 1997. The bill also eliminates a
1 19 state minimum training wage rate.
