  1  1    Section 1.  CARBONATED BEVERAGE SALES IN SCHOOLS == STUDY.
  1  2 The department of education shall conduct a study concerning
  1  3 the sale of carbonated beverages to students in schools during
  1  4 the 2005=2006 school year.  The department shall require
  1  5 school districts to provide information to the department in
  1  6 records or reports required by section 283A.5 with respect to
  1  7 school breakfast and lunch programs.  The information to be
  1  8 provided shall include the number of elementary, middle, and
  1  9 high schools within each school district that sell carbonated
  1 10 beverages to students, the method by which the carbonated
  1 11 beverages are sold, the number of locations within each school
  1 12 where the sales are made, the amount of carbonated beverages
  1 13 sold on a per pupil basis, and the gross sales amount of such
  1 14 carbonated beverages.  The information shall not include sales
  1 15 of carbonated beverages at extracurricular events.
  1 16    On or before January 15, 2007, the department of education
  1 17 shall file a report with the general assembly that contains
  1 18 its findings and recommendations, including any proposals to
  1 19 change or limit the sale of carbonated beverages in schools.
  1 20                           EXPLANATION
  1 21    This bill requires the department of education to conduct a
  1 22 study concerning the sale of carbonated beverages to students
  1 23 in schools during the 2005=2006 school year.  The department
  1 24 shall require school boards to submit information about the
  1 25 type and number of schools in each district that sell
  1 26 carbonated beverages, the method by which the beverages are
  1 27 sold, the number of locations within each school where the
  1 28 sales are made to students, the amount of such beverages sold
  1 29 on a per pupil basis, and the gross sales amount of such
  1 30 beverages in each school district.  The bill also requires the
  1 31 department of education to file a report with the general
  1 32 assembly on or before January 15, 2007, containing its
  1 33 findings and recommendations.
