  1  1    Section 1.  Section 137F.6, Code 2005, is amended by adding
  1  2 the following new subsection:
  1  3    NEW SUBSECTION.  8.  A food establishment covered by
  1  4 subsections 4 and 5 shall be assessed license fees not to
  1  5 exceed seventy=five percent of the total fees applicable under
  1  6 both subsections.  In the event that a routine inspection of a
  1  7 food establishment licensed under subsection 4 or 5 reveals
  1  8 the presence of three or more critical violations, a
  1  9 reinspection fee of one hundred dollars shall be charged for
  1 10 each reinspection.  Failure to pay the reinspection fee shall
  1 11 subject a food establishment to revocation of the food
  1 12 establishment's license pursuant to section 137F.7 and the
  1 13 penalty provisions of section 137F.17.
  1 14                           EXPLANATION
  1 15    This bill provides for a reinspection fee to be charged in
  1 16 the event that an inspection of a food establishment that
  1 17 provides food for consumption on=premises or off=premises
  1 18 reveals three or more critical violations.  The bill provides
  1 19 that the fee shall be $100 per reinspection.  The bill
  1 20 provides that failure to pay the reinspection fee shall
  1 21 subject a food establishment to revocation of the
  1 22 establishment's license and to the civil penalty provisions of
  1 23 Code section 137F.17.
