  1  1    Section 1.  Section 6A.21, subsection 1, paragraph b, Code
  1  2 2005, is amended to read as follows:
  1  3    b.  "Private development purposes" means the construction
  1  4 of, or improvement related to, recreational trails,
  1  5 recreational development paid for primarily with private
  1  6 funds, housing and residential development, or commercial or
  1  7 industrial enterprise development.
  1  8    Sec. 2.  EFFECTIVE DATE.  This Act, being deemed of
  1  9 immediate importance, takes effect upon enactment.
  1 10                           EXPLANATION
  1 11    Current law provides that agricultural land cannot be
  1 12 condemned for private development purposes, which includes
  1 13 recreational trails.  This bill removes recreational trails
  1 14 from the definition of "private development purposes".
  1 15    The bill takes effect upon enactment.
