  1  1    Section 1.  Section 455C.4, subsection 2, Code 2005, is
  1  2 amended by striking the subsection.
  1  3    Sec. 2.  Section 455C.7, Code 2005, is amended to read as
  1  4 follows:
  1  5    455C.7  UNAPPROVED REDEMPTION CENTERS.
  1  6    Any person may establish a redemption center which has not
  1  7 been approved by the department, at which a consumer may
  1  8 return empty beverage containers and receive payment of the
  1  9 refund value of the beverage containers.  The establishment of
  1 10 an unapproved a redemption center shall not relieve any dealer
  1 11 from the responsibility of redeeming any empty beverage
  1 12 containers of the kind and brand sold by the dealer.
  1 13    Sec. 3.  Section 455C.6, Code 2005, is repealed.
  1 14                           EXPLANATION
  1 15    This bill relates to acceptance of empty beverage
  1 16 containers by dealers of beverages.  The bill eliminates the
  1 17 ability of a dealer of beverages to refuse to accept any empty
  1 18 beverage container if the place of business of the dealer and
  1 19 the kind and brand of empty beverage containers are included
  1 20 in an order of the department of natural resources approving a
  1 21 redemption center.  The bill makes conforming amendments
  1 22 related to the elimination of approved redemption centers.
