1 1 Section 1. Section 123.129, subsection 4, Code 2005, is
1 2 amended to read as follows:
1 3 4. States the number of square feet of interior floor
1 4 space which comprises the retail sales area of the premises
1 5 for which the permit is sought, the number of square feet of
1 6 interior floor space of the retail sales area which is devoted
1 7 to the sale of alcoholic beverages, and the resulting
1 8 proportion, expressed as a percentage, of interior floor space
1 9 devoted to the sale of alcoholic beverages.
1 10 Sec. 2. Section 123.134, subsection 3, Code 2005, is
1 11 amended to read as follows:
1 12 3. The annual permit fee for a class "C" permit shall be
1 13 graduated on the basis of the amount proportion of interior
1 14 floor space which comprises the retail sales area of the
1 15 premises covered by the permit which is devoted to the sale of
1 16 alcoholic beverages, as follows:
1 17 a. Up to one thousand five hundred square feet ten percent
1 18 of the interior floor space devoted to the sale of alcoholic
1 19 beverages, the sum of seventy=five dollars.
1 20 b. Over one thousand five hundred square feet and up to
1 21 two thousand square feet ten percent and up to twenty percent
1 22 of the interior floor space devoted to the sale of alcoholic
1 23 beverages, the sum of one hundred dollars.
1 24 c. Over two thousand and up to five thousand square feet
1 25 twenty percent and up to thirty percent of the interior floor
1 26 space devoted to the sale of alcoholic beverages, the sum of
1 27 two hundred dollars.
1 28 d. Over five thousand square feet thirty percent of the
1 29 interior floor space devoted to the sale of alcoholic
1 30 beverages, the sum of three hundred dollars.
1 31 EXPLANATION
1 32 This bill provides for a change in the method by which
1 33 annual license fees for class "C" beer permits are calculated.
1 34 Class "C" beer permits are issued strictly to grocery stores
1 35 and pharmacies pursuant to Code section 123.129.
2 1 Currently, Code section 123.134 imposes a graduated license
2 2 fee which is based on the square footage of the interior floor
2 3 space of a premises which is devoted to retail sales. The
2 4 bill provides that instead of graduated fees based on square
2 5 footage, the fees shall be graduated based on the proportion
2 6 of interior floor space of a premises, regardless of size,
2 7 which is devoted to the sale of alcoholic beverages. The bill
2 8 maintains the current fee amounts, but provides that they will
2 9 be imposed in categories corresponding to proportions of
2 10 retail floor space devoted to alcoholic beverage sales of up
2 11 to 10, 20, 30, and over 30 percent, respectively.
2 12 The bill provides that in submitting an application for a
2 13 class "C" beer permit, an applicant shall, in addition to the
2 14 current requirement of specifying the number of square feet of
2 15 interior floor space which comprises the retail sales area of
2 16 the premises, also specify the number of square feet of
2 17 interior floor space of the retail sales area which is devoted
2 18 to the sale of alcoholic beverages, and the resulting
2 19 proportion, expressed as a percentage, of interior floor space
2 20 devoted to the sale of alcoholic beverages.
