Section 282.9, subsection 1, Code 2005, is 1 2 amended to read as follows: 1 3 1. Notwithstanding sections 275.55A, 256F.4, and 282.18, 1 4 or any other provision to the contrary, prior to knowingly 1 5 enrolling an individual who is required to register as a sex 1 6 offender under chapter 692A, but who is otherwise eligible to 1 7 enroll in a public school, the board of directors of a school 1 8 district shall determine the educational placement of the 1 9 individual. Upon receipt of notice that a studentwho is1 10 currently enrolled in the district is required to register as 1 11 a sex offender under chapter 692A, the board of directors of 1 12 the school of enrollment shall determine the educational 1 13 placement of the student. The tentative agenda for the 1 14 meeting of the board of directors at which the board will 1 15 consider such enrollment or educational placement shall 1 16 specifically state that the board is considering the 1 17 enrollment or educational placement of an individual who is 1 18 required to register as a sex offender under chapter 692A. If 1 19 the individual is denied enrollment in a school district under 1 20 this section, the school district of residence shall provide 1 21 the individual with educational services in an alternative 1 22 setting. 1 23 EXPLANATION 1 24 This bill makes clear that when the board of directors of a 1 25 school district is notified that a student currently enrolled 1 26 in the school district is required to register as a sex 1 27 offender, the board must determine the educational placement 1 28 of the student. 1 29 LSB 1787XS 81 1 30 kh:nh/pj/5
