A BILL FOR
1 An Act prohibiting the issuance of new licenses to conduct
2 gambling games near a horse racetrack enclosure and providing
3 an effective date.

1 1 Section 1. Section 99F.7, subsection 1, Code 2005, is
1 2 amended to read as follows:
1 3 1. If the commission is satisfied that this chapter and
1 4 its rules adopted under this chapter applicable to licensees
1 5 have been or will be complied with, the commission shall issue
1 6 a license for a period of not more than three years to an
1 7 applicant to own a gambling game operation and to an applicant
1 8 to operate an excursion gambling boat. However, the
1 9 commission shall not issue any licenses to conduct gambling
1 10 games under this chapter in addition to the number of licenses
1 11 issued as of January 1, 2005, for a facility to be located
1 12 within fifty miles of a horse racetrack enclosure to which a
1 13 license to conduct gambling games has been granted under this
1 14 chapter. The commission shall decide which of the gambling
1 15 games authorized under this chapter the commission will
1 16 permit. The commission shall decide the number, location, and
1 17 type of excursion gambling boats licensed under this chapter
1 18 for operation on the rivers, lakes, and reservoirs of this
1 19 state. An excursion gambling boat may be located or operated
1 20 on a natural or man=made lake or reservoir if the lake or
1 21 reservoir is of sufficient size to accommodate recreational
1 22 activity. An excursion gambling boat may also be located on a
1 23 man=made basin or other body of water adjacent to a river,
1 24 provided it is located no more than one thousand feet from the
1 25 high water mark of the river, as established by the commission
1 26 in consultation with the United States army corps of
1 27 engineers, the department of natural resources, or other
1 28 appropriate regulatory agency. The license shall set forth,
1 29 as applicable, the name of the licensee, the type of license
1 30 granted, the place where the excursion gambling boats will
1 31 operate and dock, and the time and number of days during the
1 32 excursion season and the off season when gambling may be
1 33 conducted by the licensee.
1 34 Sec. 2. EFFECTIVE DATE. This Act, being deemed of
1 35 immediate importance, takes effect upon enactment.
2 1 EXPLANATION
2 2 This bill provides that no new licenses to conduct gambling
2 3 games can be issued for a facility that would be located
2 4 within 50 miles of a horse racetrack that has been issued a
2 5 license to conduct gambling games.
2 6 The bill takes effect upon enactment.
