  1  1    Section 1.  NEW SECTION.  91B.3  BUSINESS REQUESTS WITH
  1  2 EMPLOYEE DATA PROHIBITED.
  1  3    A business entity doing business in the state shall not as
  1  4 a condition of transacting business request or require another
  1  5 business entity to provide copies of any state or federal
  1  6 government forms, tax forms, or filings from which data can be
  1  7 traced to an individual employee.  For purposes of this
  1  8 section, "business entity" means a partnership, firm,
  1  9 association, corporation, sole proprietorship, or other
  1 10 business entity.  A violation of this section is a serious
  1 11 misdemeanor.
  1 12                           EXPLANATION
  1 13    This bill prohibits a business entity from requesting or
  1 14 requiring certain state or federal information of another
  1 15 business entity from which data can be traced to an individual
  1 16 employee of the responding business entity.  The bill defines
  1 17 "business entity" for purposes of the provision.  The bill
  1 18 provides a penalty.  A violation is a serious misdemeanor.  A
  1 19 serious misdemeanor is punishable by confinement for no more
  1 20 than one year and a fine of at least $250 but not more than
  1 21 $1,500.
