  1  1    Section 1.  STATE FIRE CODE == ADVISORY COMMITTEE
  1  2 ESTABLISHED.
  1  3    1.  The division of fire protection in the department of
  1  4 public safety shall establish a state fire code advisory
  1  5 committee.  The state fire marshal shall serve as chairperson
  1  6 of the committee.  Members shall include a representative of
  1  7 each of the following, appointed by the respective entity or
  1  8 that entity's successor, or, in the case of members appointed
  1  9 pursuant to paragraphs "b" through "e", appointed by the state
  1 10 fire marshal:
  1 11    a.  The state fire service and emergency response council.
  1 12    b.  State and local building inspectors.
  1 13    c.  A licensed engineer.
  1 14    d.  A licensed architect.
  1 15    e.  The homebuilding industry.
  1 16    f.  The Iowa association of professional fire chiefs.
  1 17    g.  The department of inspections and appeals.
  1 18    h.  The state fire marshal association.
  1 19    i.  The Iowa firemen's association.
  1 20    The chairperson may designate additional entities for
  1 21 inclusion on the committee.
  1 22    2.  Members shall serve staggered terms of two years.
  1 23 Appointments of members of the committee shall comply with
  1 24 sections 69.16 and 69.16A.  Vacancies shall be filled by the
  1 25 original appointing authority and in the manner of the
  1 26 original appointment.
  1 27    3.  Members shall receive actual expenses incurred while
  1 28 serving in their official capacity and may also be eligible to
  1 29 receive compensation as provided in section 7E.6.  A majority
  1 30 of the members of the committee shall constitute a quorum.
  1 31    4.  The advisory committee shall review existing fire
  1 32 safety codes, identify instances where codes have become out=
  1 33 of=date or where conflicts exist between various codes,
  1 34 consider the advantages to be gained from an integrated fire
  1 35 code, and make recommendations for the implementation of an
  2  1 integrated state fire code.  The committee shall submit a
  2  2 report of its recommendations to the members of the general
  2  3 assembly by January 1, 2007.
  2  4    5.  This section shall not be interpreted as affecting the
  2  5 authority of the state fire marshal or the state building code
  2  6 commissioner to promulgate rules pursuant to chapter 17A.
  2  7                           EXPLANATION
  2  8    This bill provides for the formation of an advisory
  2  9 committee to examine alternatives and develop an
  2 10 implementation plan regarding adoption of an integrated state
  2 11 fire code.
  2 12    The bill provides that the committee shall be established
  2 13 by the division of fire protection in the department of public
  2 14 safety, with the state fire marshal serving as chairperson.
  2 15 The bill provides that members shall include representatives
  2 16 from the state and local building inspectors, licensed
  2 17 engineers and architects, the homebuilding industry, the Iowa
  2 18 association of professional fire chiefs, the state fire
  2 19 service and emergency response council, the department of
  2 20 inspections and appeals, the state fire marshal association,
  2 21 the Iowa firemen's association, and additional entities as
  2 22 designated by the chairperson.
  2 23    The bill provides that the committee shall review existing
  2 24 fire safety codes, identify instances where codes have become
  2 25 out=of=date or where conflicts exist between various codes,
  2 26 consider the advantages to be gained from an integrated fire
  2 27 code, and make recommendations for the implementation of an
  2 28 integrated state fire code.  The bill provides that the
  2 29 rulemaking authority of the state fire marshal and the state
  2 30 building code commissioner is unaffected by this provision.
  2 31 The bill provides that the committee shall submit a report of
  2 32 its recommendations to the members of the general assembly by
  2 33 January 1, 2007.
