1 An Act providing for the use of biomass as an additive or
2 supplement to natural gas.

1 1 Section 1. Section 15E.111, subsection 1, paragraph b,
1 2 Code 2005, is amended to read as follows:
1 3 b. Renewable fuel production facilities. As used in this
1 4 section, "renewable fuel" means an energy source which is
1 5 derived from an organic compound biomass and which is capable
1 6 of powering machinery, including an engine or power plant.
1 7 "Biomass" means any organic matter that is available on a
1 8 renewable or recurring basis, including but not limited to
1 9 agricultural crops and trees, wood and wood wastes and
1 10 residues, plants, grasses, residues, fibers, animal wastes,
1 11 municipal wastes, and other waste materials.
1 12 c. Biomass research and development. Persons who are
1 13 engaged in an innovative enterprise involving the research and
1 14 development or the initial production of the use of biomass as
1 15 an additive or supplement to natural gas.
1 16 Sec. 2. Section 15E.111, subsection 2, paragraph a, Code
1 17 2005, is amended to read as follows:
1 18 a. The person, including an existing or proposed facility,
1 19 is located in this state.
1 20 Sec. 3. Section 15E.111, subsection 4, unnumbered
1 21 paragraph 1, Code 2005, is amended to read as follows:
1 22 The department shall select an applicant which is an
1 23 existing or proposed facility to receive financial assistance
1 24 based on the following criteria:
1 25 EXPLANATION
1 26 This bill amends Code section 15E.111, which provides for a
1 27 value=added agricultural products and processes financial
1 28 assistance program, is administered by the department of
1 29 natural resources and supported by a special fund referred to
1 30 as the value=added agricultural products and processes
1 31 financial assistance fund created in Code section 15E.111.
1 32 The purpose of the program is to encourage the increased
1 33 utilization of agricultural commodities produced in this
1 34 state. The department is required to support the development
1 35 of new innovative products and processes related to
2 1 agriculture. An application based on innovation must be
2 2 considered if the production process is not commonly available
2 3 in this state and the production is not commonly produced in
2 4 this state. The department is also authorized to support
2 5 renewal fuel production facilities.
2 6 The bill requires the department to support persons who are
2 7 involved in the research and development or the initial
2 8 production of the use of biomass as an additive or supplement
2 9 to natural gas. "Biomass" is defined to mean any organic
2 10 matter that is available on a renewable or recurring basis.
